CONFERENCE: Relocating Governance in Asia: state and society in South- and Southeast Asia, c. 1800-2000 (22-24 January 2020, Leiden)



We learned of a conference on state and society in South- and Southeast Asia (c. 1800-2000) at the Universiteit Leiden.

Conference

Over the last decades, the study of governance in Asia has increasingly expanded to include a focus upon non-state entities. Historians have realized that engagement with local intermediaries, civil society organizations, power brokers, and interest groups has been crucial to the day-to-day administration of European colonies and postcolonial states alike. Historically, colonial regimes contended and interacted with pre-existing political and socioeconomic structures of the regions they occupied and sought to reshape. Simultaneously there has been a continued awareness that ideas, methods and policies did not develop in isolation in each colony, but instead circulated in trans-imperial networks. Similarly, nation states in postcolonial republics from Indonesia to India and Pakistan have been compelled to seek dialogue with non-state actors, even as their solutions to challenges from these quarters have been informed by wider discourses on statecraft.

This conference seeks to bring together these different insights in comparative perspective, to shed light on the many paradoxes, differences and continuities of (post)colonial rule across Asia. We seek to highlight the different sources and brokers of power in colonial and postcolonial societies, and the manner in which these interacted, contradicted, overlapped with and challenged the authority of the state. The aim is to bring this wider context of governance into focus, by crossing regional and temporal boundaries and including colonial and postcolonial states in the same framework of research.

Confirmed keynote speakers are prof. dr. Indrani Chatterjee (University of Texas at Austin), prof dr. Robert Cribb (Australian National University) and dr. Farish A. Noor (Nanyang Technological University, Singapore).

This is a N.W. Posthumus conference co-sponsored by the programme AMT: Asian Modernities and Traditions, the Vereniging KITLV / Royal Netherlands Institute of Southeast Asian and Caribbean Studies, the Institute for History (Leiden University) and the Faculty of Law (Leiden University).

CALL FOR PROPOSALS: Rencontres doctorales pluridisciplinaires. – Theme : La preuve (Tours, 4-5 May 2020) (DEADLINE : 6 March 2020)




We learned of the 4th Rencontres doctorales pluridisciplinaires organized by the Association des Doctorants du Centre d’études supérieures de la Renaissance, on the theme of « la preuve ».

Présentation

Pour la 4eannée consécutive, l’Association des Doctorants du Centre d’études supérieures de la Renaissance (ADCESR) organise à Tours ses Rencontres doctorales pluridisciplinaires. Cette année les journées d’études porteront sur le thème de la preuve à la Renaissance. Elles se tiendront les 4 et 5 mai 2020 à Tours, au Centre d’études supérieures de la Renaissance (CESR).

Argumentaire

La redéfinition du champ intellectuel par l’humanisme à partir du Quattrocento entraîne une réévaluation des rapports entre vérité et connaissance. Le raisonnement peut-il, sinon atteindre la vérité, du moins garantir une certitude suffisante ? La précédente édition des Rencontres a montré l’intérêt épistémologique qu’il y a à interroger les rapports du vrai et du faux à la Renaissance. Nous proposons cette année de resserrer ce questionnement autour de la notion de preuve, dans ses élaborations théoriques aussi bien que dans ses mises en œuvre pratiques. En effet, si l’établissement de la preuve est un procédé discursif observable dans tout type d’énoncé, celui-ci prend aussi corps dans des champs pratiques et des cadres institutionnels en transformation au début de l’époque moderne.

La notion de preuve a surtout été thématisée par les historiens du droit et des sciences. Un effort de formalisation des protocoles s’observe en effet à la Renaissance, à travers la multiplication des traités juridiques cherchant à régler l’usage des modi probationum comme dans la métamorphose du statut de l’observation dans les sciences physiques et la médecine. Les discussions autour de l’écriture de la preuve s’inscrivent ainsi dans un ensemble de pratiques professionnelles et institutionnelles qu’il s’agira de mettre en lumière. Le cadre pluridisciplinaire de cette journée d’étude offre l’occasion d’élargir l’examen à l’ensemble des champs du savoir et de la pratique, afin d’analyser la preuve et les modes de son établissement.

La richesse du sujet semble par ailleurs liée à la fonction intermédiaire de la preuve : au moyen de dispositifs qui sont pour la plupart de nature rhétorique, elle consiste autant à construire un consensus qu’à établir la vérité. Cette bivalence est d’autant plus manifeste à la Renaissance, alors que les distinctions entre les disciplines ne sont pas encore fixées. L’extension des champs du savoir entraîne de nouvelles pratiques qui exposent les définitions les plus techniques de la preuve à des usages nouveaux et variés. Les participants pourront s’appuyer sur ces quelques éléments de définition pour orienter leur réflexion autour des pistes suivantes :

  • Élaborations théoriques de la preuve : comment la notion est-elle définie dans le discours savant des sciences, du droit, de la logique ?
  • Modes d’apport de la preuve : comment les processus probatoires évoluent-ils à l’aube de l’époque moderne ?
  • Influences croisées entre théorie et pratique : quels rapports entretiennent théoriciens et praticiens de la preuve, là où la preuve est à la fois concept et instrument ?
  • Transferts et échanges : les définitions et les usages de la preuve font-ils l’objet d’une circulation entre les différentes disciplines ?
  • Ces usages professionnels débordent-ils leur domaine premier pour s’inscrire dans les transformations du champ social et politique ?
Modalités pratiques

Les propositions de communication de doctorant.es et de jeunes docteur.es devront être envoyées à l’adresse mail de l’ADCESR : asso.doctorants.cesr@gmail.com, avant le 6 mars 2020. Elles résumeront la communication en 250 mots maximum et seront accompagnées de quelques lignes de présentation (laboratoire, sujet et directeur de recherche).

Les interventions – en français, en anglais ou en italien – dureront vingt minutes et pourront s’inscrire dans tous les domaines d’études de la Renaissance (histoire, histoire de l’art, histoire des sciences et des techniques, histoire du droit et de la médecine, musicologie, littérature, philosophie), sur une période allant de Pétrarque à Descartes.

Cette journée d’étude s’achèvera par une table ronde ouverte aux participants et aux étudiants de master du CESR, autour des pratiques de la recherche.

Le CESR invitera les participants à déjeuner mais le transport et l’hébergement resteront à leur charge.

Ce livre a l’ambition d’ouvrir une nouvelle dimension pour l’histoire des relations internationales en étudiant la naissance, en Europe, d’une diplomatie prenant en compte le monde entier, où les Européens cherchent à être présents en ce temps de première mondialisation. Les traités de paix, signés à partir de 1713 à Utrecht puis à Rastatt et à Baden, mettent fin à un conflit qui dure depuis 1701, la guerre de Succession d’Espagne, et ils règlent en particulier le sort de l’immense monarchie espagnole qui contrôle des territoires sur tous les continents. Depuis les traités de Westphalie de 1648, le congrès diplomatique s’est imposé comme l’instrument des grandes recompositions géopolitiques destinées à établir la paix. Une telle réunion de négociateurs correspond à une confrontation maîtrisée où sont évalués les résultats des campagnes militaires et où sont cherchés des expédients pour faire accepter l’arrêt des hostilités. Pour des siècles trop souvent considérés comme des successions de guerres, par lesquelles des États en formation s’imposent en s’opposant, ce recueil d’études propose d’approcher l’histoire de l’Europe et du monde sous un autre angle, plus lumineux : celui de la négociation, puisque l’affrontement débouche aussi sur l’élaboration de pratiques destinées à résorber à tout prix la violence entre les pays européens. Néanmoins, cela conduit aussi à esquiver des litiges ou des souffrances collectives pour ne pas retarder ou empêcher la conclusion des traités. Finalement, une paix durable, comme celle de 1713-1714, fait de tous les belligérants des mécontents, tout en les obligeant à accepter un oubli général des traumatismes subis. Ces discussions intègrent les questions économiques, commerciales et coloniales, ce qui permet de parler de diplomatie-monde, afin d’aborder le dialogue avec des populations lointaines mais aussi des drames humains comme la traite des esclaves africains. Cet ouvrage se propose de considérer également les fondements d’une culture de paix, à travers l’émergence d’une opinion publique internationale, la réflexion sur la paix perpétuelle, la construction d’un événement historique qu’il faut célébrer et commémorer.

ABOUT THE BOOK

During more than a century of colonial rule over Algeria, the French state shaped and reshaped the meaning and practice of Muslim law by regulating it and circumscribing it to the domain of family law, while applying the French Civil Code to appropriate the property of Algerians. In Sex, Law, and Sovereignty in French Algeria, 1830–1930, Judith Surkis traces how colonial authorities constructed Muslim legal difference and used it to deny Algerian Muslims full citizenship. In disconnecting Muslim law from property rights, French officials increasingly attached it to the bodies, beliefs, and personhood.

Surkis argues that powerful affective attachments to the intimate life of the family and fantasies about Algerian women and the sexual prerogatives of Muslim men, supposedly codified in the practices of polygamy and child marriage, shaped French theories and regulatory practices of Muslim law in fundamental and lasting ways. Women's legal status in particular came to represent the dense relationship between sex and sovereignty in the colony. This book also highlights the ways in which Algerians interacted with and responded to colonial law. Ultimately, this sweeping legal genealogy of French Algeria elucidates how "the Muslim question" in France became—and remains—a question of sex.

This book examines the evolution of Australian unemployment law and policy across the past 100 years. It poses the question 'How does unemployment happen?' But it poses it in a particular way. How do we regulate work relationships, gather statistics, and administer a social welfare system so as to produce something we call 'unemployment'? And how has that changed over time?

Attempts to sort workers into discrete categories – the 'employed', the 'unemployed', those 'not in the labour force' – are fraught, and do not always easily correspond with people's working lives. Across the first decades of the twentieth century, trade unionists, statisticians and advocates of social insurance in Australia as well as Britain grappled with the problem of what forms of joblessness should be classified as 'unemployment'. This book traces those debates. It also chronicles the emergence and consolidation of a specific idea of unemployment in Australia after the Second World War. It then charts the eventual unravelling of that idea, and relates that unravelling to the changing ways of ordering employment relationships.

In doing so, Inventing Unemployment challenges the preconception that casual work, self-employment, and the 'gig economy' are recent phenomena. Those forms of work confounded earlier attempts to define 'unemployment' and are again unsettling our contemporary understandings of joblessness.

This thought-provoking book shows that the category of 'unemployment', rather than being a taken-for-granted economic variable, has its own history, and that history is intimately related to our changing understandings of 'employment'.

This monograph makes a major new contribution to the historiography of criminal justice in England and Wales by focusing on the intersection of the history of law and crime with medical history. It does this through the lens provided by one group of historical actors, medical professionals who gave evidence in criminal proceedings. They are the means of illuminating the developing methods and personnel associated with investigating and prosecuting crime in the eighteenth and nineteenth centuries, when two linchpins of modern society, centralised policing and the adversarial criminal trial, emerged and matured. The book is devoted to two central questions: what did medical practitioners contribute to the investigation of serious violent crime in the period 1700 to 1914, and what impact did this have on the process of criminal justice? Drawing on the details of 2,600 cases of infanticide, murder and rape which occurred in central England, Wales and London, the book offers a comparative long-term perspective on medico-legal practice — that is, what doctors actually did when they were faced with a body that had become the object of a criminal investigation. It argues that medico-legal work developed in tandem with and was shaped by the needs of two evolving processes: pre-trial investigative procedures dominated successively by coroners, magistrates and the police; and criminal trials in which lawyers moved from the periphery to the centre of courtroom proceedings. In bringing together for the first time four groups of specialists — doctors, coroners, lawyers and police officers — this study offers a new interpretation of the processes that shaped the modern criminal justice system.

Katherine D. Watson is a Reader in History at Oxford Brookes University and a Fellow of the Royal Historical Society. Her research interests focus on areas where medicine, crime and the law intersect, including the history of infanticide and crimes against children, forensic medicine and science, and an unusual form of assault known as vitriol throwing. She is the author of Poisoned Lives: English Poisoners and their Victims (2004) and Forensic Medicine in Western Society: A History (2011).

Esta figura constitucional significó un suceso trascendental en Brasil, ya que fue utilizada 44 veces y permaneció vigente en un 20% de los 39 años que duro la Primera República (1889-1891). El libro discute su implementación en la ley brasileña y nos explica los usos y abusos del Estado de Sitio de Deodoro da Fonseca hasta Washington Luis. A partir de un abordaje institucional, Gasparetto explora una variedad de cuestiones más exhaustivas, como la circulación transnacional de modelos jurídicos o el autoritarismo de la Primera República. La Constitución de Brasil, de tendencia estadounidense, estuvo regulada con rasgos de centralismo y autoritarismo francés. El Estado de Sitio, justificado originalmente en caso de invasión extranjera, fue tergiversado y usado en la conservación del orden social interno. CALL FOR PAPERS: First Student Conference on Legal History Iustoria 2020 (Belgrade, 25-26 March 2020) (DEADLINE: 15 January 2020)



We learned that the University of Belgrade Faculty of Law is receiving paper proposal for its first student conference on legal history. Here the call:

The University of Belgrade Faculty of Law is now receiving paper proposals for the First student conference on legal history – the Iustoria 2020, to be held on the 25th and 26th of March, 2020, its topic being “Law Codes and Women”.

The choice of this subject stems from an anniversary – this year marks the 175th anniversary of the Serbian Civil Code (1844), and one of the most heavily debated issues during its creation was precisely the regulation of the position of women: a woman’s right to inherit, her role in the family, the legal capacity of a married woman… Without a doubt, dilemmas such as these were present in the minds of other creators of civil codes pertaining to the 19th and the beginning of the 20th century – however, this is but a small portion of the issues that fall under the realm of this conference. What was the status of women as perpetrators – or victims – of crimes in criminal codes? What was the procedural status of women as parties in lawsuits or as witnesses? Did commercial codes contain special rules for women merchants? When we move further into the past, the very presence of norms that are concerned with the status of women in the legal codes of the Antiquity and the Middle Ages tells us a lot about their position in society, and many laws contain specific and original institutions that deserve scholarly attention. In recent history we could divert our attention to women as lawmakers, and analyse their influence on modern codes of law. We are looking forward to proposals related to these and many other issues pertaining to the main subject!

All students of graduate and post-graduate studies pertaining to law or other humanities are eligible to apply for the conference. The applications should contain basic personal information (name and surname, faculty, department, level and year of study), along with an abstract containing anywhere between 500 and 1000 words.

The applications should be e-mailed to iustoria@ius.bg.ac.rs before the 15th of January, 2020. The students will be informed by the 25th of January whether or not their application has been accepted. A provisional programme for the conference will be announced by the 1st of February. Drafts of the chosen papers need to be sent by the 15th of March. Apart from the presentations given by their colleagues, the students at the conference will have an opportunity to attend several lectures given by renowned experts – more details on this will be available in the final version of the programme.

As a general rule, the participants who do not reside in Belgrade are expected to cover the travelling and accomodation expenses by themselves. Exceptionally, there is a possibility of securing accomodations either at the student dorms or with student host families for those students who are unable to finance their stay at Belgrade. These arrangements will depend on the number of available spots.

The final versions of the papers presented at the conference, with final changes and corrections submitted within a reasonable time after the conference, will be published in the first issue of the future student journal for legal history!

Book abstract:
The original Latin text of Johann Gröning’s Navigatio libera has never before been translated into any modern vernacular language. Gröning’s intention was to set out the position of neutral nations (in this case the Danes and Swedes), and their right to pursue trade during the wars of the great maritime powers (particularly the English and the Dutch). It specifically sought to engage with and refute the work of Hugo Grotius while taking cognisance of the critique of Gröning’s work by Samuel Pufendorf. The text serves as a bridge between 17th-century polemical discourse surrounding the ‘free sea’ versus ‘enclosed sea’ debate and later 18th-century legal literature on the rights of neutrals and the continuation of free trade in time of war.

Peter Maxwell-Stuart, Ph.D. (1994) is Reader in History at the University of St Andrews. He is widely published in the fields of Greek and Latin literature and history, and in the occult sciences of Mediaeval and early modern Europe. He is about to publish a translation of Gomez Pereira’s scientific treatise, Antoniana Margarita, and Martin Delrio’s chef d’oeuvre, Disquisitiones Magicae. Steve Murdoch, Ph.D. (1998) is Professor of History at the University of St Andrews. His major monographs include; Network North: Scottish Kin, Cultural and Covert Associations in Northern Europe, 1603-1746 (Brill, 2006) and most recently with Alexia Grosjean, Alexander Leslie and the Scottish Generals of the Thirty Years’ War, 1618-1648 (Pickering & Chatto, 2014). Among maritime scholars he is best known for his award winning monograph The Terror of the Seas? Scottish Maritime Warfare, 1513-1713 (Brill, 2010). Leos Müller, Ph.D. (1998), is Professor of History and Director of the Centre for Maritime Studies, Stockholm University. He has published on Swedish early-modern and maritime history, e.g. Consuls, Corsairs and Commerce. The Swedish Consular Service and Long-Distance Shipping, 1720–1815 (Uppsala University, 2004), together with Stefan Eklöf Amirell, and Persistent Piracy. Maritime Violence and State-formation in Global Historical Perspective, (Palgrave Macmillan, 2014).
