La Deliberazione nella causa dei poveri del domenicano Domingo de Soto (1495-1560), uno dei grandi maestri della cosiddetta seconda scolastica, è un breve trattato in dodici capitoli, che a distanza di quasi mezzo millennio colpisce ancora il lettore per la sua forza argomentativa e per la sua capacità di resistenza alle pretese del potere e del diritto secolari di imporsi a guida e controllo delle coscienze. Domingo de Soto (Segovia, 1494 - Salamanca, 1560), è stato uno dei maggiori teologi della Spagna nella prima modernità. Studente ad Alcalà de Henares nel 1513, quattro anni dopo era a Parigi. Entrò nell’Ordine dei Predicatori nel 1524, divenendo dottore in teologia l’anno successivo. Insegnò a Segovia e quindi a Salamanca, università che lasciò per divenire il confessore dell’imperatore Carlo V, in rappresentanza del quale prese parte al Concilio di Trento. Nel 1548 partecipò come teologo cattolico alla redazione dell’Interim di Augusta, con il quale la Dieta imperiale convocata da Carlo V stabilì un compromesso con i principi che aderivano alla religione riformata, in attesa delle deliberazioni del Concilio. Esponente di primo piano della cosiddetta Seconda Scolastica, fu uno strenuo difensore ed interprete del pensiero di Tommaso d’Aquino, il cui spirito si trova trasfuso in questa sua opera del 1545, dedicata all’erede al trono Filippo, il futuro Filippo II, e concepita a difesa del diritto dei poveri a migrare e a chiedere sostentamento nel nome di Dio. Altre opere, tutte di grande significato nella storia del pensiero occidentale, sono quelle nel campo della logica (Summulae, 1529; In dialecticam Aristotelis commentarii, 1544), della fisica (In VIII libros physicorum, 1545), della teologia (De natura et gratia libri III, 1547; In IV Sententiarum libros commentaria 1555-1556), della politica e del diritto (Commentarium in Epistulam ad Romanos, 1550; De justitia et jure libri X, 1556, la sua opera più importante).

ABOUT THE EDITOR

Valentina Benacchio (1993), ha compiuto i suoi studi al Liceo Brocchi di Bassano del Grappa, sua città natale, e si è laureata in Giurisprudenza nell’Università di Trento, sotto la guida di Diego Quaglioni. I suoi interessi di studio sono rivolti alla letteratura teologico-giuridica della prima età moderna e in particolare alla questione della povertà nel dibattio cinquecentesco.

ABOUT THE BOOK

The essays in this volume explore the ways rights were available to those in the margins of society. By tracing pivotal judicial concepts such as ‘right of necessity’ and ‘subjective rights’ back to their medieval versions, and by situating them in unexpected contexts such as the Franciscans’ theory of poverty and colonization or today’s immigration and border control, this volume invites its readers to consider whether individual rights were in fact, or at least in theory, available to the marginalized. By focusing not only on the economically impoverished but also those who were disenfranchised because of disability, gender, race, religion or infidelity, this book also sheds light on the relationship between the early history of individual rights and social justice at the margins.

ABOUT THE EDITORS

Virpi Mäkinen is Senior Lecturer in Theological and Social Ethics at the University of Helsinki, Finland. She has published monographs and many articles on medieval and early modern intellectual history, including Property Rights in the Late Medieval Discussion on Franciscan Poverty (Peeters, 2001), and co-edited Transformations in Late Medieval and Early-Modern Rights Discourse (Springer, 2006). 

Jonathan Robinson, Ph.D. (2010) in Medieval Studies at the University of Toronto, Canada. He currently acts as a lawyer and is the author of William of Ockham’s Theory of Property Rights in Context (Brill, 2012).

Pamela Slotte is Associate Professor of Minority Studies at the Åbo Akademi University, Finland. She is the co-author of The Juridification of Religion (Brill, 2017) and co-editor of Revisiting the Origins of Human Rights (Cambridge University Press, 2015). 
Heikki Haara is Senior Lecturer of Political History at the University of Helsinki. He is the author of Pufendorf’s Theory of Sociability: Passions, Habits and Social Order (Springer, 2018).

Boydell & Brewer have published a new book on English poor law.

ABOUT THE BOOK

Between 1660 and 1841, some 149 "corporations of the poor" were created in England through local acts. By uniting a number of parishes, these "corporations" hoped to deal more effectively with the growing problem of pauperism. This volume, focussing on 33 parishes in the hundreds of Loes and Wilford in east Suffolk, is the first detailed exploration of a rural incorporation. The incorporation's approach towards the poor was truly revolutionary: setting the able-bodied to work in the purpose-built house of industry, educating the children, punishing the indolent, and caring for the sick and impotent in a humane way. By charting the incorporation's complete history, this volume allows for the exploration of the wide range of social policies implemented during those years. Through a wealth of documents, we witness the zeal of the initial promoters in the 1760s; the construction and management of the House; the development of medical services; the problems faced by the economic crisis of the 1790s; and, as costs continued to rise, the gradual disillusionment of the local elites, leading to the institution's demise in 1826.
