ABOUT THE BOOK

In this meticulously researched volume, Vincent Chang resurrects a near forgotten yet pivotal chapter of Dutch-Chinese ties to narrate how World War II, the civil war in China, and Indonesia’s decolonization redefined and remade this age-old bilateral relationship.
Drawing on a unique range of hitherto unexplored archives, the book explains how China’s nascent rise on the global scene and the Netherlands’ simultaneous decline as a colonial power shaped events in Dutch-controlled Indonesia (and vice versa) and prompted a re-calibration of their mutual ties, culminating in the Netherlands’ recognition of the People’s Republic and laying the foundations for Dutch and Chinese policies through to the present.
Offering insightful analyses of power dynamics and international law at the close of empire, this book is a critical resource for historians and China specialists as well as scholars of international relations.

ABOUT THE AUTHOR

Vincent K.L. Chang, PhD (2016), a Dutch lawyer and historian, is Associate Professor of History at Southwest University (China) specializing in modern Chinese history and diplomacy. He also teaches at Leiden University and serves as a fellow of the LeidenAsiaCentre.

Abstract:
The Vienna Congress of 1814/15 was a major event, attended by monarchs, diplomats and lobbyists, but also by adventure seekers, dancers and actors to represent their interests, to do business or to enjoy themselves. It provided the opportunity to compose pieces of music and to create many works of fine art, so that it has remained alive in the collective memory until today. The reorganization of Europe agreed at the congress had lasted for half a century. The 34 authors from ten countries analyse the Vienna Congress and its consequences. Both the internationality and the interdisciplinary nature of the research offer new perspectives on the event that changed Europe and the world forever.

BOOK REVIEW: Ann THOMSON on Jürgen OSTERHAMMEL, Unfabling the East: The Enlightenment’s Encounter with Asia (American Historical Review 2020)

First paragraph:
Jürgen Osterhammel’s Die Entzauberung Asiens, published in 1998, with a second edition in 2013, has acquired the status of something of a classic in the German-speaking world. Its translation into English after twenty years is therefore long overdue and very welcome. This translation, Unfabling the East: The Enlightenment’s Encounter with Asia, by Robert Savage, is a revised and updated version of the original, which has thus allowed Osterhammel to take account of a certain amount of more recent literature; he indicates that it should be seen as the “standard edition” of the work. The choice of “unfabling” in the title rather than the more common translation of Entzauberung as “disenchantment” was made, as Osterhammel explains on pages 30–31, in order to avoid discussions of its meaning for Max Weber and to draw the reader’s attention to what he sees as eighteenth-century travelers’ deliberate undermining of “the fabled East.” It is also interesting that “Asia” in the original German title has been replaced by “the East,” with Asia relegated to the subtitle. In addition, the German subtitle referred to Europe in the eighteenth century rather than the Enlightenment; it might perhaps have been preferable to follow the German original here, as the period under study is the long eighteenth century, from around 1680 to around 1830.

BOOK: Caroline DERRY, Lesbianism and the Criminal Law - Three Centuries of Legal Regulation in England and Wales (London: Palgrave Macmillan, 2020). ISBN 978-3-030-35300-1, 92,64 €

(Source: Routledge)

Routledge is publishing a new book on lesbianism and criminal law in English and Welsh legal history.

ABOUT THE BOOK

This book offers a comprehensive examination of the ways in which the criminal justice system of England and Wales has regulated, and failed or refused to regulate, lesbianism. It identifies the overarching approach as one of silencing: lesbianism has not only been ignored or regarded as unimaginable, but was deliberately excluded from legal discourses. A series of case studies ranging from 1746 to 2013 from parliamentary debates to individual prosecutions shed light on the complex process of regulation through silencing. They illuminate its evolution over three centuries and explore when and why it has been breached. The answers Derry uncovers can be fully understood only in the context of surrounding social and legal developments which are also considered. Lesbianism and the Criminal Law makes an important contribution to the growing bodies of literature on feminism, sexuality and the law and the legal history of sexual offences.

ABOUT THE AUTHOR

Caroline Derry is Lecturer in Law at the Open University, UK. She taught for fifteen years at London Metropolitan University where she was a senior lecturer in Criminal and Evidence Law and Gender and Law, and LLB course leader. She has been a visiting lecturer in Criminal Law at SOAS and at Paris Descartes. She is a co-author of Complete Criminal Law (OUP, 2018) and Gender and Law (Routledge, 2018).

CALL FOR PAPERS: Law, Theology, and the Moral Regulation of “Economy” in the Early-Modern Atlantic World (Chicago, 23 April 2021) (DEADLINE: 15 March 2020)

We learned of a call for papers for a conference on “Law, Theology, and the Moral Regulation of “Economy” in the Early-Modern Atlantic World” in Chicago.

This is a call for papers in anticipation of a one-day conference to be organized by Brian Owensby (University of Virginia) and Richard Ross (University of Illinois) through the Symposium on Comparative Early Modern Legal History [https://law.illinois.edu/faculty-research/specialty-programs/legal-history/].  The conference, to be held at the Newberry Library in Chicago on Friday, April 23, 2021 is entitled, “Law, Theology, and the Moral Regulation of ‘Economy’ in the Early-Modern Atlantic World.”  The time is long past when the Western world’s emergent commercial culture could be understood solely in terms of a Protestant ethos or the division between commerce and social morality occasioned by the Protestant Reformation. Scholarship has shown that “modern” ideas regarding commerce and “economics” had their roots in late-medieval Catholic thought and in neo-scholastic ideas that blended theology, justice, and law. It is clear as well that the rise of commercial thinking was not a linear intellectual development. Protestants and Catholics alike, facing the moral and social implications of novel “economic” relations, undertook deep theological and legal reflections regarding unbridled, competitive, exchange-oriented gain seeking. Many of these concerns were raised in the context of Europe’s westward expansion to the New World. Usury, just price, interest, legal personality, slavery, reciprocity, property, cases of conscience, doubts regarding self-regulating mechanisms, concerns for the poor—all figured in a vibrant legal discourse that simultaneously elaborated and critiqued a set of ideas regarding human economy that became dominant between the sixteenth and nineteenth centuries. This conference will bring together historians, legal scholars, and social scientists to investigate law’s historical role in enabling and regulating behaviors now recognized as foundational to modern economies.

Interested presenters should submit an abstract of between 200 and 500 words and a c.v. by March 15, 2020.  Please send submissions and inquiries to Richard Ross [rjross@illinois.edu]; 217-244-7890.  No previously published work will be accepted. Applicants will be notified by email shortly after the submission deadline.  Accepted participants will be required to submit a full paper of no more than 10,000 words by the end of February 2021. Papers will be pre-circulated and read by all participants.  The conference will pay for travel and hotel expenses.

CALL FOR PAPERS: International Days of the Society for Legal and Institutional History of Flanders, Picardy and Wallonia (Middelburg, 22-23 MAY 2020)

Welgekozen woorden kunnen een norm verdichten (zoals `we hold these truths to be self-evident’; or `en fait des meubles la possession vaut titre’).

Justice, religion et société devant l’inacceptable (Sources, 2019)

The AHMUF anounced the publication of a theme issue of Sources: Arts, Civilisation et Histoire de l'Europe on Religion, justice and society against the inacceptable.

BOOK: Ron HARRIS, Going the Distance: Eurasian Trade and the Rise of the Business Corporation, 1400-1700 (Princeton: Princeton University Press, 2020). ISBN 9780691150772, £34.00

Princeton University Press is publishing a new book on Eurasian trade and the rise of the business corporation (1400-1700).

ABOUT THE BOOK

Before the seventeenth century, trade across Eurasia was mostly conducted in short segments along the Silk Route and Indian Ocean. Business was organized in family firms, merchant networks, and state-owned enterprises, and dominated by Chinese, Indian, and Arabic traders. However, around 1600 the first two joint-stock corporations, the English and Dutch East India Companies, were established. Going the Distance tells the story of overland and maritime trade without Europeans, of European Cape Route trade without corporations, and of how new, large-scale, and impersonal organizations arose in Europe to control long-distance trade for more than three centuries.

Ron Harris shows that by 1700, the scene and methods for global trade had dramatically changed: Dutch and English merchants shepherded goods directly from China and India to northwestern Europe. To understand this transformation, Harris compares the organizational forms used in four major regions: China, India, the Middle East, and Western Europe. The English and Dutch were the last to leap into Eurasian trade, and they innovated in order to compete. They raised capital from passive investors through impersonal stock markets and their joint-stock corporations deployed more capital, ships, and agents to deliver goods from their origins to consumers.

Going the Distance explores the history behind a cornerstone of the modern economy, and how this organizational revolution contributed to the formation of global trade and the creation of the business corporation as a key factor in Europe’s economic rise.

Mohr Siebeck is publishing a book on historical and comparative approaches to the “causa contractus” in different European legal traditions.

ABOUT THE BOOK

European legal tradition uses the notion of causa or la cause both to identify a contract's underlying purpose and to address the reasons for its enforcement. By combining a historical analysis of the causa doctrine with comparative studies of various national systems, this volume seeks to promote a common understanding of Europe's legal heritage and to present proposals for its further development. Contributions are in German, French, Italian and English, summarized by introductory chapters in English.

BOOK: Xenophon CONTIADES & Alkmene FOTIADOU (eds.), Routledge Handbook of Comparative Constitutional Change (London: Routledge, JUL 2020), ISBN 9781138496644, 190 GBP

Abstract:
Comparative constitutional change has recently emerged as a distinct field in the study of constitutional law. It is the study of the way constitutions change through formal and informal mechanisms, including amendment, replacement, total and partial revision, adaptation, interpretation, disuse, and revolution. The shift of focus from constitution-making to constitutional change makes sense, since amendment power is the means used to refurbish constitutions in established democracies, enhance their adaptation capacity and boost their efficacy. Adversely, constitutional change is also the basic apparatus used to orchestrate constitutional backslide as the erosion of liberal democracies and democratic regression is increasingly affected through legal channels of constitutional change. The Routledge Handbook of Comparative Constitutional Change provides a comprehensive reference tool for all those working in the field and a thorough landscape of all theoretical and practical aspects of the topic. Coherence from this aspect does not suggest a common view, as the chapters address different topics, but reinforces the establishment of Comparative Constitutional Change as a distinct field. The book brings together the most respected scholars working in the field, and presents a genuine contribution to comparative constitutional studies, comparative public law, political science and constitutional history.

CALL: Legal History on the Web

The Legal History Blog issued a call from Duke University for further links in its Legal History on the Web Directory:
Second Call for Information about Legal History Websites/Multimedia Projects for “Legal History on the Web”Many of you may have had occasion to use “Legal History on the Web,” a gateway to online resources related to legal history that we started at Duke University in 2006.  This year we are undertaking a long-overdue update of the site, building on the platform first created by Mitch Fraas and revised by Ashton Merck, both working with and under the direction of Ed Balleisen.
We particularly invite suggestions for websites to include in a couple of new categories, as well as sites that engage with legal history outside the United States and the UK.
We are already well into the process of fixing broken links by updating URLs and revising annotations for existing websites where advisable.  If you know of any websites that require updates or that you think merit inclusion on “Legal History on the Web,” please send along the relevant information to Siobhan Barco, at siobhan.barco@duke.edu.
Please feel free to send along suggested text for annotations to any new links that you nominate for inclusion.  That suggested text needs to be short – just a few lines that encapsulate what the site has to offer legal historians (see current annotations for examples).Existing Categories:

(See for example, Ed Balleisen’s Suckers & Swindlers in American History, a companion site to his Fraud: An American History from Barnum to Madoff, which includes an extensive bibliography, essay about sources and methods, essay about avenues for future research, compilations of fraud-related slang, and much else besides.)

BOOK: Vincenzo FERRONE, The Enlightenment and the Rights of Man (Oxford: Oxford University Press, 2020), ISBN 9781789620368, $99.99.

(Source: OUP)

Oxford University Press is publishing a new book on the enlightenment and the rights of man.

ABOUT THE BOOK

The Enlightenment redefined the ethics of the rights of man as part of an outlook that was based on reason, the equality of all nations and races, and man's self-determination. This led to the rise of a new language: the political language of the moderns, which spread throughout the world its message of the universality and inalienability of the rights of man, transforming previous references to subjective rights in the state of nature into an actual programme for the emancipation of man.

Ranging from the Italy of Filangieri and Beccaria to the France of Voltaire, Rousseau and Diderot, from the Scotland of Hume, Ferguson and Smith to the Germany of Lessing, Goethe and Schiller, and as far as the America of Franklin and Jefferson, Vincenzo Ferrone deals with a crucial theme of modern historiography: one that addresses the great contemporary debate on the problematic relationship between human rights and the economy, politics and justice, the rights of the individual and the rights of the community, state and religious despotism and freedom of conscience.

ABOUT THE AUTHOR

Vincenzo Ferrone has written extensively on the Enlightenment and Ancien régime Europe. He has taught and held fellowships at the Princeton Institute for Advanced Study, Ca' Foscari University in Venice, and the Collège de France in Paris. He is currently Professor of Modern History at the University of Turin.

ABOUT THE BOOK

ISBN 978-3-412-50899-9, 110.00 EUR

Vandenhoeck & Ruprecht has published a new book on legal scholars in the Roman republic.

ABOUT THE BOOK

ABOUT THE AUTHOR

Christine Lehne-Gstreinthaler ist Assistenzprofessorin am Institut für Römisches Recht und Rechtsgeschichte der Universität Innsbruck.
