ABOUT THE BOOK

The notion that, upon the advent of the English in 1167, all Gaelic peoples in Ireland were immediately and ipso facto denied access to the English royal courts has become so widely accepted in popular culture that it is often treated as fact. In this ground-breaking monograph, however, the narrative of absolute ethnic discrimination in thirteenth- and early fourteenth-century English Ireland is for the first time tackled head-on through a thorough re-examination of the Irish plea rolls. Through a forensic study of these records, the author demonstrates not only that there was a great deal of variation in how members of various ethnic groups and women who came before the English royal courts in Ireland were treated, but also that there was a large — and hitherto scarcely noticed — population of Gaels with regular and unimpeded access to English law, and that the intersections between gender/sex and ethnicity have too often been deeply misunderstood or disregarded. A close comparison between the treatment of Gaelic women and men and that of the English of Ireland, together with an in-depth examination of other ethnicities from around the Irish Sea, provide a new understanding of English Ireland in which it is clear that there was not a simple dichotomy between the English and the unfree, but rather that people lived an altogether more complex and nuanced existence.

Canon law touched nearly every aspect of medieval society, including many issues we now think of as purely secular. It regulated marriages, oaths, usury, sorcery, heresy, university life, penance, just war, court procedure, and Christian relations with religious minorities. Canon law also regulated the clergy and the Church, one of the most important institutions in the Middle Ages. This Cambridge History offers a comprehensive survey of canon law, both chronologically and thematically. Written by an international team of scholars, it explores, in non-technical language, how it operated in the daily life of people and in the great political events of the time. The volume demonstrates that medieval canon law holds a unique position in the legal history of Europe. Indeed, the influence of medieval canon law, which was at the forefront of introducing and defining concepts such as ‘equity,’ ‘rationality,’ ‘office,’ and ‘positive law,’ has been enormous, long-lasting, and remarkably diverse.


THE AUTHORS

Anders Winroth, taught medieval history at Yale University from 1998–2020, and currently teaches at the University of Oslo. The author of The Making of Gratian’s ‘Decretum,’ (Cambridge University Press, 2000) which revolutionized our understanding of medieval canon law, he was a named a MacArthur Foundation Fellow in 2003. He serves as President of the Institute of Medieval Canon Law.

John C. Wei, holds a Ph.D. in medieval history from Yale University and a J.D. from Yale Law School. He is the author of Gratian the Theologian (2016) and the editor of the decretist Reverentia sacrorum canonum. He has authored many articles on medieval law and theology.

Chiara Valentini è ricercatrice in filosofia del diritto nell’Università di Bologna. È stata «Ramon y Cajal Fellow» nel Dipartimento di Diritto della Universitat Pompeu Fabra di Barcellona e «Max Weber Fellow» nell’European University Institute. Pour les juristes français, les formes du testament sont le résultat d’une combinaison produite par l’influence du droit romain, des coutumes de l’ancienne France et de la législation révolutionnaire. L’apport du droit canonique à la formation du droit moderne et contemporain du testament, bien que majeur, est le plus souvent totalement passé sous silence. La réintroduction du testament au XIIe siècle est incontestablement due à la redécouverte du Corpus Juris Civilis. Cet ensemble fournit du procédé une définition particulièrement claire, l’entendant comme un acte de dernière volonté révocable. L’influence du droit romain, d’abord importante dans le Midi, a donc conditionné la diffusion de l’institution dans la pratique. Très tôt, cependant, s’est opéré un mouvement de simplification des formes exigées. La plupart des règles romaines sont écartées. L’Église n’exige en réalité aucune formalité, mais seulement des preuves de l’acte. Cette attitude très souple permet au plus grand nombre de tester, le plus souvent simplement par oral. Ouvrir à chacun une telle possibilité a bien sûr d’abord pour but de permettre à tous les chrétiens d’effectuer des legs pieux susceptibles, au-delà du rachat de leurs fautes, de venir enrichir le patrimoine ecclésiastique. Cette politique n’en débouche pas moins sur une promotion sans précédent de l’acte à cause de mort et de la liberté de disposer.

Andrew Cecchinato is a Marie Skłodowska-Curie Global Fellow at the University of Michigan Law School and the School of History at the University of St Andrews. He is a book review editor for the American Journal of Legal History. Andrew has received scholarships from the Max-Planck-Institute für europäische Rechtsgeschichte and the Robert H. Smith International Center for Jefferson Studies. He has also been a visiting researcher at the Robbins Collection in Civil and Religious Law, the Georgetown University Law Center, and the Library of Congress. He studied law at the University of Trento, where his Ph.D. on The Legal Education of Thomas Jefferson won the faculty prize.

ABOUT THE BOOK

This book presents the proceedings of the international conference “The Middle Ages in the Modern World,” held in Rome November 21-24, 2018. Attended by more than a hundred participants of different ages, educational backgrounds, and places of origin, the conference constituted a landmark in the study of medievalism: the historical discipline, now in full bloom, that investigates the ways in which the thousand-year period between 500 and 1500 was, and continues to be, presented, reconstructed, and imagined in successive eras. The book opens with a substantial bibliography drawn from all of its components, followed by the seven keynote lectures and ninety-three shorter texts - abstracts of the individual conference papers - organized along eight thematic pathways, which together provide a vivid image of the current state of the field.


THE EDITORS

Tommaso di Carpegna Falconieri is Associate Professor of Medieval History at the University of Urbino. He works on the history of central Italy, political medievalism, and historical method.

Pierre Savy is Director of Medieval Studies at the École française de Rome. His research focuses on Northern Italy in the late Middle Ages (political society, Jewish communities).

Lila Yawn is Associate Professor and Director of the Master of Arts in Art History at John Cabot University. She researches illuminated manuscripts and Rome in the Middle Ages.

ABOUT THE BOOK

Medio evo del diritto, come titolo di un’opera di storia, può forse saper di astrattezza e ha bisogno di essere giustificato: proprio sul terreno storico, dove le astrattezze non allignano. Non è facile. Medio evo – si dice – è soltanto un concetto della nostra mente, qualcosa dunque di relativo, e destinato a sparire quando le ragioni che lo generarono si saranno consumate nella nostra coscienza. E diritto – si dice anche – è una cosa che i giuristi cercano ancora di definire. Queste, le basi dell’astrattezza del titolo, se pur è da ammettere che un’astrattezza abbia basi. Tuttavia, se vogliamo esser sinceri, confessiamo pure che quelle astrattezze sono state per secoli gli spiragli attraverso i quali lo spirito umano è riuscito a intravedere qualcosa di concreto: altrimenti, non avremmo potuto nemmeno pensare quelle astrattezze.
E a questi spiragli vorremmo che altri occhi si accostassero ancora e ficcasser lo viso: ma, perché essi non temano di veder delle nebbie, noi vogliamo dir subito, adoprando parole tutte dell’uso comune, che codesto qualcosa di concreto è semplicemente una storia del diritto, che ha come sua epoca il medio evo, come teatro d’azione l’Italia. Ma qui ci nasce l’obbligo di dar conto di ciascuna di queste affermazioni, e proprio per paura dell’uso comune che le ha consacrate, e spesso fraintese. Le ha fraintese in modo particolarmente grave di fronte al primo e fondamentale problema che quella storia pone, e cioè quello delle fonti del diritto. Da questo, perciò, sentiamo il bisogno di rifarci.

Francesco Calasso (1904-1965) è stato un giurista e accademico italiano, uno dei più importanti studiosi del diritto comune. Dal 1955 fino alla morte fu preside della Facoltà di Giurisprudenza dell'Università "La Sapienza" di Roma.

Dans la continuité des travaux menés par ses membres depuis les années 2000, le Comité d’histoire parlementaire et politique (CHPP) célébrera scientifiquement son vingtième anniversaire les 21, 22 et 23 septembre 2022 par la tenue d’un colloque international consacré aux pouvoirs parlementaires et politiques en temps de crise et d’exception. Il réinterrogera, dans une perspective résolument comparative et de longue durée, les notions de crise, d’exception, d’état d’urgence avec les regards croisés disciplinaires les plus larges des sciences humaines et sociales : historiens, politistes, juristes, économistes, sociologues, démographes. 

ANNOUNCEMENT

Argumentaire

Le 74e congrès de la Commission internationale pour l’histoire des assemblées d’État (CIHAE) se déroulera à Paris du 21 au 23 septembre 2022. Il est organisé par la section française de la CIHAE et le Comité d’histoire parlementaire et politique (CHPP), qui célèbrera à cette occasion son vingtième anniversaire, en partenariat avec la Société française d’histoire politique, le laboratoire POLEN (Pouvoirs, lettres, normes – université d’Orléans), le centre d’études des mondes moderne et contemporain (CEMMC – Université de Bordeaux Montaigne) et le centre de la Méditerranée moderne et contemporaine (CMMC – Université de Noce Côte d’Azur).

La coordination scientifique est assurée par Jean Garrigues (président du CHPP), Pierre Allorant, (secrétaire général du CHPP) et Walter Badier (secrétaire général du CHPP).

Il réinterrogera, dans une perspective résolument comparative et de longue durée, les notions de crise, d’exception, d’état d’urgence avec les regards croisés disciplinaires les plus larges des sciences humaines et sociales : historiens, politistes, juristes, économistes, sociologues, démographes.

Le terme de « crise » a d’abord été employé en médecine pour évoquer le « moment d’une maladie caractérisé par un changement subit et généralement décisif, en bien ou en mal » (Ambroise Paré). Par analogie, la crise en est venue à désigner une « phase grave dans l’évolution des choses des événements, des idées, une perturbation, une rupture » d’ordre économique, financière, monétaire, politique, ministérielle, institutionnelle, morale, diplomatique, internationale, militaire, voire de civilisation, opposée aux temps d’équilibre, de calme et de prospérité. Pour Georges Duhamel, « la crise de civilisation se manifeste par des troubles politiques, sociaux, économiques, certes, et tous les observateurs s’efforcent de comprendre ces troubles, de les expliquer, d’envisager leurs conséquences ».

L’exception désigne en droit tout moyen invoqué pour faire écarter une demande judiciaire sans discuter le principe du droit sur lequel elle repose, et en procédure civile le moyen de forme invoqué pour critiquer la procédure ou en suspendre l’effet. De même un tribunal d’exception, par opposition à un tribunal de droit commun, n’est compétent que pour les matières qui lui sont expressément attribuées par une loi ; un régime ou une loi d’exception déroge au droit commun à l’égard d’une catégorie de personnes. Stendhal n’a cessé de dénoncer « le régime de terreur, d’exception, de délation, de surveillance policière » de la Restauration, là où Marcel Prélot illustre la législation d’exception par le régime de Vichy qui « disperse et éloigne des postes de commande les éléments qui sont réputés faire contrepoids à l’autorité étatique ».

L’état d’urgence est une forme de régime d’exception qui permet aux autorités administratives centrales (ministère de l’Intérieur) et déconcentrées (préfectorales) de prendre des mesures temporaires de restriction des libertés, justifiées par le risque grave d’atteinte à l’ordre public, du fait de la menace terroriste (lois françaises du 3 avril 1955, article 16 de la constitution de 1958) ou récemment sanitaire.

Le séminaire du CHPP, tenu tout au long de 2021 en dépit de…la crise sanitaire, a permis d’interroger les notions de crise, d’urgence, d’exception. De quoi la crise est-elle le nom ? Comment se manifestent crise monétaire et crise financière ? Sont-elles les ferments d’une crise économique ou des révélateurs d’une crise de régime ? Vivons-nous une nouvelle crise des élites ? Comment s’articulent crise institutionnelle et crise de régime ? Ces analyses juridiques, historiques et économiques ont été complétées par un regard renouvelé sur le phénomène révolutionnaire, grâce à deux approches, par « en haut » et par « en bas », du plan national à l’échelle locale. Si présentes dans les débats publics en France et en Europe, les questions migratoires fournissent également un terrain d’observation privilégié des crises contemporaines. Géographes, sociologues et historiens s’intéressent tout à la fois aux variations des discours et des politiques menées depuis la Seconde Guerre mondiale et aux tragédies de notre actualité, de la Manche à « l’amère Méditerranée ». Enfin, face à la confusion médiatique et aux récupérations partisanes du thème de la laïcité, un retour sur les fondements de la loi de Séparation de 1905 s’est avéré indispensable pour décrypter enjeux et instrumentalisations contemporaines des postures et des polémiques relatives à la place des cultes dans l’espace public.

Le défi que souhaite relever le Comité d’Histoire Parlementaire et Politique à la faveur de ce colloque international est de multiplier les échelles afin de tester la validité et le caractère opérationnel des questionnements soumis, au plan national, lors de ses ateliers de 2021, en les transportant et transposant à l’échelle européenne et internationale, sans laisser de côté les angles locaux, régionaux et nationaux.

  • À l’occasion de ce colloque seront revisitées les notions de crise, d’état d’urgence, de pouvoirs exceptionnels et de législations d’exception, afin de vérifier leur pertinence au-delà du cadre hexagonal et les risques de pérennisation de normes présentées à l’origine comme de nature temporaire.
  • La typologie des crises, soulignée par le séminaire, sera également réinterrogée à la lumière comparatiste : crise sanitaire, migratoire, économique, financière, monétaire, sociales, institutionnelle, de régime, gouvernementale…
  • La question des échelles, du local à l’international en passant par le régional, le national, le Conseil de l’Europe et le Parlement européen (communautaire) sera mobilisée avec pour objectif d’embrasser toutes les nuances et formes de parlementarisme.
  • Dans ce cadre résolument international, les propositions de communications présentant une dimension comparée seront favorisées et valorisées.
  • Au-delà du périmètre européen, les travaux et débats gagneront à s’élargir à la dimension coloniale et impériale, en particulier à travers l’étude des assemblées spécifiques, comme celles de l’Union française, mais aussi sous l’angle de l’impact des crises coloniales sur la vie parlementaire des pays européens (Royaume-Uni, Pays-Bas, Belgique, Portugal, France…).
  • En transversalité, la thématique du genre sera privilégiée dans le but de renouveler certaines approches.

    ABOUT THE BOOK

    Il volume affronta due questioni principali che derivano dalle opere del grande giurista medievale Bartolo da Sassoferrato, per cui è stata eseguita, per la prima volta, la lettura integrale delle opere che gli sono state attribuite, con confronti testuali su manoscritti ed incunaboli. La prima questione appunto riguarda la problematica testualità di tali opere e si intreccia con la storia della tradizione e del fenomeno di ricezione conosciuto come “bartolismo”. Il secondo aspetto deriva dalla natura delle lezioni di questo giurista il quale, attraverso esempi e questioni tratti dalla realtà perugina della prima metà del Trecento, consente ai suoi studenti di comprendere i testi giuridici che sta commentando. In tal modo è stato possibile all’autore delineare svariati profili della vita quotidiana con particolare riguardo alle istituzioni politiche, ai processi, ai tributi, alla moralità pubblica, alla vita dell’università e degli scolari, alla documentazione degli atti giuridici, con riferimenti ai mestieri, alle donne, agli ebrei, ai francescani, ai proverbi ed alla lingua volgare.

    ARTICLE: Richard REID, Africa’s Revolutionary Nineteenth Century and the Idea of the “Scramble” (AHR CXXVI (2021), No. 4 (Dec), 1424-1447)

    Abstract:

    This paper seeks to position the Scramble for Africa in the context of the continent’s transformative, global nineteenth century. While imperial historiography develops apace, Africa-facing analyses of the continent’s partition and the processes which led to it are increasingly rare. European expansion into Africa was characterized by an aggressive dynamism, and millions of Africans experienced profound crisis in the process of the establishment of colonial rule. Yet Africa’s revolutionary nineteenth century was both driven by, and culminated in, complex processes of co-option on the part of Africans and Europeans. The paper proposes that a more Africa-centered assessment of the Scramble is possible, one which aims to contextualize the partition of the continent as part of an ongoing, endogenously shaped but often exogenously connected, transformation in political, economic, and social organization and behavior. While no single overarching theory can apply to the entire continent, it is possible to identify dynamics and processes for change that recur across Africa, from political and military reform to economic innovation. These point toward possibilities for reframing Africa’s development in the late precolonial period, and enable us to challenge the hegemony long enjoyed by scholars of European empires.

    LECTURE SERIES: Commissions of Inquiry and the Remaking of British Colonial Slavery, 1822 – 1831 (Law and History Workshop, 1 March 2022, ONLINE)

     


    We learned that the next seminar of the Law and History Workshop organized by the Stanford Center for Law and History will be held on Tuesday, March 1, from 12:45-2:00PM (Pacific) in Room 320D, Stanford Law School, and via Zoom. 

    Lisa Ford and Naomi Parkinson, University of New South Wales History, will share the paper: "Commissions of Inquiry and the Remaking of British Colonial Slavery, 1822 – 1831." Professor Ford and Dr Parkinson will be presenting the paper via Zoom but participants will be able to attend either in-person or online.

    ABSTRACT

    In the early 1820s, the Liverpool Government launched an ambitious program to reform the condition of slaves across its Empire. Driven by the ‘Saints’ in Parliament, the British Colonial Office attempted to introduce uniform rights and protections for slaves in British colonies. The Trinidad Ordinance, first introduced in 1824 and eventually imposed on Britain’s crown colonies, was one medium for reform. Commissions of Inquiry, dispatched to almost every British colony from 1818-1830 and tasked with reporting back on the state of slavery, were another.

    This paper examines the role Commissions of Inquiry played as instigators of and witnesses to this wider project of imperial reform. It argues that the commissioners had a marginal role in setting the terms of slavery’s amelioration, as their recommendations for law reform almost always arrived too late to shape imperial policy. However, the commissions had more impact on the ground. Focusing on the Cape, we show how the Commissioners of Eastern Inquiry inserted themselves into everyday conflicts between slaves, masters and officials, taking on the role of de facto protectors. Their investigation of slave complaints was unusual, but showcases an important function of commissions of inquiry, nevertheless. They embodied the Crown in empire, creating new pathways of complaint and surveillance that bound peripheries and center in the aftermath of the Napoleonic War.

    ABOUT THE BOOK

    Ce volume est l’aboutissement d’un itinéraire de recherche collective de plusieurs années regroupant des chercheurs français et italiens. Issu d’un programme de l’EFR intitulé « Statuts, écritures et pratiques sociales dans les sociétés de la Méditerranée occidentale (XII e-XV e siècle) » (2012-2016), il rassemble les papiers de synthèse des cinq colloques qui ont été organisés dans la cadre de ce programme accompagnés d’une introduction et d’une conclusion.

    Les « corpus statutaires » définis comme « tout type de texte qui se présente comme une forme écrite et stabilisée du droit local, édictée par une autorité publique » y sont étudiés de leur confection à leur usage social dans un souci comparatiste entre deux aires géographiques et traditions historiographiques distinctes : l’Italie communale et le Midi de la France. Après l’analyse de leur forme matérielle, du vocabulaire et des langues utilisées, l’ouvrage s’intéresse aux « acteurs » de la norme, à la rhétorique et à l’écriture puis replace la matière statutaire dans son paysage documentaire pour mesurer les circulations documentaires en analysant les points de contact entre les statuts et les autres documents produits par les autorités communales, par des institutions de la commune et par une autorité supérieure, avant d’étudier l’organisation interne des statuts, le plan adopté et les principaux thèmes abordés pour terminer sur l’usage des statuts dans les autres formes documentaires.

    L’historiographie italienne a fait des statuts communaux des monuments. Nous avons tenté d’en refaire ce qu’ils étaient, c’est-à-dire des documents, objets matériels produits en contexte par des hommes de terrain pour vivre en commun et créer du lien social.

    Didier Lett est professeur d’Histoire médiévale à l’Université de Paris et membre senior honoraire de l’Institut universitaire de France.     DATABASE: Cartae Europae Medii Aevi


    The aim of Cartae Europae Medii Aevi is to offer historians multiple resources for the study of medieval diplomatic documents on a European scale, including the corpus of the same name. The website already contains several sections:

    In its current state, the database contains over 270,000 documents. We obviously wish to continue the development of the corpus (plain text charters, editions, features, tools, etc.), with with updates in the coming months. A dataset will soon be available for download.
    Charters are one of the most widespread cultural legacies of medieval Europe. They are found in hundreds of thousands, probably millions, and are present in almost every archive in the world. Because they constituted a fundamental memorial support for the institutions or individuals who produced or received them, they were often kept until modern times by the institutions responsible for them – most often ecclesiastical. Sometimes destroyed during the 16th-18th centuries, they were nevertheless generally preserved by archivists and carefully examined by historians, who found in them a fundamental doorway for the study of medieval society as early as the 17th century.

    Charters constitute essential material for understanding the evolution of the medieval system, both material and ideal, its written practices, but also its thinking and the tensions that run through it. By making it possible to interrogate a very large number of charters simultaneously, the aim is to study the chronology of the phenomena, but also their geography and their impact. The global consultation of the corpus also allows the comparison of chancery and scriptoria practices on a very large scale, making it possible to observe circulations well beyond regional or national borders.
    Conservation and Edition
    Published en masse in the 19th and 20th centuries, in regional or national collections, the charters are indeed a monument for historians. Digitised in the context of more or less extensive scientific programmes from the 1960s onwards, they were often grouped together in corpuses isolated from each other until the 2000s. Since 2009, the corpus of the Cartae Europae Medii Aevi (CEMA) has aimed to bring them together in a single set, both for conservation and for the interrogation of the files.
    While our initial objective was primarily to produce a dataset for our data mining experiments, it soon became apparent that it would be desirable to disseminate this collection to a wider audience. In this perspective, in addition to the consultation of the proceedings on the present website, we would like to eventually propose a dataset, in agreement with our partners. It will make it possible to establish a ground truth for statistical and linguistic surveys on charters on a European scale. However, such a project would obviously not be possible without the previous programmes which, as early as the 1960s, chose to convert these documents into computer format. As the saying goes, the CEMA are nani gigantum humeris insidentes.
    Digitizing Charters
    The corpus thus counts today more than 270,000 documents, corresponding to about 80 million words. Most of the texts are in Latin, but some are also found in vernacular languages – from Old French to Norwegian, Middle High German and Hispanic languages. Our aim is to provide a site where all historians can simultaneously find these invaluable resources for the study of Europe’s past, facilitating regional as well as national comparisons.
