This volume collects essays presented at a conference organised by the editor in 2017 to mark the five-hundredth anniversary of the Reformation. Comprising thirteen chapters, the book is divided into four parts: (I Church Law and the Reformation; (LI) Catholic and Protestant Approaches to Law in the Life of the Church; (III) Catholic and Protestant Approaches to Church and State Law; and (IV) Catholic and Protestant Approaches to Particular Areas of Law.
The book situates itself in the wake of influential scholarship on law and the Reformation, including works by John Witte Jr (Law and Protestantism, 2002). Harold J Berman (Law and Revolution II, 2003), Mathias Schmoeckel (Das Recht der Reformation, 2014; Das Recht der Reformation in Frankreich, 2024), Martin Heckel (Martin Luthers Reformation und das Recht, 2016), and Robert von Friedeburg (Luther's Legacy, 2016), to mention only a few. As the editor notes in the preface, the core message of the book is that '500 years after it occurred the sundering of Christendom at the Reformation still resonates in the law, but equally the Reformation was not an isolated event. It was the product of forces in society that were present before Martin Luther nailed his theses to the church door at Wittenberg and to this extent the Reformation did not create change in all cases but instead recognised new forces at work in society and at times accelerated changes which, had the Reformation not occurred, might well have come about anyway' (xiii).
The volume is not fully homogeneous. Its contributions vary significantly in chronological scope, methodological approach, and confessional focus. Some chapters concentrate primarily on the early modern period, while others extend their analysis into the contemporary era. Some focus exclusively on Catholic ot Protestant contexts, while the majority attempt a comparative perspective. Inevi- tably, chapters that seek to offer broad overviews from the Reformation, or even from the late medieval period, can only provide succinct accounts, often relying more heavily on secondary literature than on primary sources. Nevertheless, the effort to connect early modern legal developments with contemporary legal frameworks is one of the book's notable strengths. As David Mclroy observes. 'the debates within and between the different strands of Christianity which emerged from the Reformation were a key factor in the development of legislation in respect of freedom of religion, civil rights and human rights'.

Die französische Rechtsgeschichte ist in Deutschland noch immer zu wenig bekannt: Die Erfindung der Gewaltentrennung wird Montesquieu zugeschrieben, nicht Claude de Seyssel, der dies aufgrund der Abnabelung der französischen Kirche von Rom um 1515 erstmals vertrat. Der Beginn der Diskussionen zur Verfassung und von Grundrechten liegt nicht im 18. Jahrhundert, sondern bei Jean Calvin bzw. dem Schock nach dem Bartholomäusnacht-Massaker. Ziel war der Erhalt des Königreichs unter einem Monarchen, der den verschiedenen Religionen als Rechtsgemeinschaften ebenso wie den Bürgern durch Recht gesicherte Möglichkeiten eines sicheren Lebens in Religionsvielfalt versprach. Mathias Schmoeckel analysiert das Vordringen der Reformation in der Rechtsordnung und Jurisprudenz, analysiert den Begriff »mos gallicus«, und beschreibt dann die Veränderungen des französischen Rechts in Bezug auf die Methoden und Quellen der Rechtswissenschaftler sowie die Auswirkungen auf die Religions- und Staatsordnung sowie ausgewählte Fragen des Zivil- und Strafrechts. Er zeigt, dass das »goldene Zeitalter« der französischen Jurisprudenz durch Guilleaume Farel und Calvin im Sinne einer »Reformation des Lebens« entwickelt wurde, um die herkömmliche Rechtsordnung zu überdenken und feste Rechte für Katholiken und Protestanten gleichermaßen zu gestalten. Dabei wirkten insbesondere die methodischen Anregungen des Philipp Melanchthon; die Juristen um ihn waren bekannt und wurden herangezogen, um sie weiterzuentwickeln. Die Auseinandersetzung mit dem Humanismus ging auch in Frankreich eine Verbindung mit der Reformation ein und führte zu einer neuen Wertschätzung der lokalen Rechtstraditionen. Alle Zweige der Rechtswissenschaft entwickelten neue Anregungen und bedeutende Literatur, die für die weitere juristische Entwicklung in Europa grundlegend wurden. Die insoweit fast unbekannte französische Reformation tritt hier in ihrer Bedeutung für die europäische Geistesgeschichte und Staatsentwicklung in den gleichen Rang neben die deutsche und die englische Reformation.

In The Excommunication of Elizabeth I, Aislinn Muller examines the excommunication and deposition of Queen Elizabeth I of England by the Roman Catholic Church, and its political afterlife during her reign. Muller shows that Elizabeth’s excommunication was a crucial turning point for both Catholics and Protestants, one that irrevocably changed attitudes towards the queen, widened political participation and resistance, and posed a destabilising threat to her regime. The Excommunication of Elizabeth I demonstrates how this event exacerbated religious tensions in England’s foreign and domestic politics, and how Elizabeth’s conflict with the papacy shaped the development of anti-Catholicism in post-Reformation England.
ABOUT THE AUTHOR
Aislinn Muller obtained her Ph.D. in History at the University of Cambridge (2017). Her work on religious politics in post-Reformation England has appeared in publications such as British Catholic History and Studies in Church History. This is her first book.
