Conference theme: ‘Oral sources and Non-traditional legal sources’

Legal historians have traditionally looked to cases, statutes, and juristic literature. Yet the history of law has never been confined to such conventional legal sources. The use of oral sources and non-traditional materials raise important methodological questions for legal historians: what counts as a legal source? and how might law and history be written differently?

The 2026 conference theme invites consideration of oral sources and non-traditional legal sources, in every sense, in the context of law and history. Some conference streams will focus specifically on oral sources, including oral testimony, oral history, memory, storytelling, folklore, and intergenerational transmission. The theme invites participants to reconsider the sources of law and history.

Oral sources are especially important for histories of Indigenous law. We invite papers on tikanga Māori, Aboriginal and Torres Strait Islander customary law, and practices grounded in kinship, place, obligation, authority, and procedure. Such work may examine how colonial legal systems have misunderstood, appropriated, suppressed, or transformed Indigenous legal knowledge.

The conference also invites engagement with non-traditional legal sources more broadly, including newspapers, petitions, letters, council decisions, archival records, folklore, family histories, demographic material, and socio-economic data. Newspapers, for example, were forums in which trials were reported, in which the reputations of parties could be sensationalised, and by which communities could engage with the law. In essence, newspapers and other non-traditional sources can illuminate how law was experienced in everyday life.

This conference invites participants to explore oral and non-traditional legal sources. Themes may include: the challenges of using oral and non-traditional sources; customary law; the relationship between memory and the law; and the role of non-traditional sources to explore law and society.

Papers are welcome from all periods, jurisdictions, disciplines, and methodological approaches. We also welcome papers that are outside of the conference theme.

This conference is a co-hosted event supported by Monash University and the University of Canterbury.

The American Society for Legal History Book Club is a monthly event series that will bring together ASLH members to engage virtually with authors about their recently published books.

The Book Club will provide ASLH members the opportunity to gather on a regular basis throughout the year and discuss recently published work.  In doing so, our hope is to sustain and enrich the existing legal history community as well as welcome new people, some of whom may be new to thinking of themselves as doing legal history.

Each Book Club will feature a conversation between an author and an interlocutor of their choosing, followed by Q&A. Book Club events will be 1 hour, on Zoom, hosted by the ASLH Digital Initiatives Working Group.  Events will be held monthly, typically on Wednesdays, 6-7 pm (central).

There is no expectation that audience members will have read the book; discussion will be structured accordingly.

• Eligibility:  Books published since January 2021 (major articles will also be considered). Scholars at all career stages working in all geographic and chronological fields of legal history (or work expected to be of interest to legal historians) can apply. ASLH membership is not required to present at the Book Club. This call is for Book Club events from Sept. 2023-March 2024.  (There will be a second call for Book Club Events from April – Aug. 2024.)

The deadline for applications is 18 October 2022 at 14:00 (Italian Time). Late applications for the ECO Department are accepted until all positions are filled. However, candidates in this field are likewise strongly advised to apply by the deadline.

 

The Max Weber Programme (MWP) at the European University Institute (EUI) is a unique postdoctoral programme in the historical and social sciences in Europe. It is open to applicants who are within 5 years from the completion of their PhD, from anywhere in the world, regardless of nationality. The Programme is highly selective, with an annual acceptance rate of <5% for a total of 55-60 Fellowships in the fields of political and social sciences, economics, law, and history. Preference is given to applicants who have only just completed their doctorate and have not had a postdoctoral fellowship before. Selected Fellows will benefit from the stimulating combination of a global programme located in the heart of Europe offering a broad menu of multidisciplinary and disciplinary activities.

The Programme awards 1 and 2 year long fellowships according to departments. In extraordinary cases only can a fellowship be extended to a third year.

The grant provided by the Fellowship is currently 2,070 EUR per month plus - when appropriate - a family allowance. Fellows in the Department of Economics and Political and Social Sciences who stay on for a second year will have the possibility of applying for a Part-time assistant professor contract (level ASSPR6/3) for 12 months involving some teaching duties and mentoring Ph.D. researchers: net remuneration would be approximately 850 EUR in addition to the monthly grant. The MWP operates a parental leave policy.

In addition to the scholarships funded by the Max Weber Programme itself, there are additional grants available that are funded by governments/foundations in Finland, Greece, Poland, Slovenia, Spain and Japan to which nationals of these countries (and in some cases residents in these countries) may also apply. Suitable applicants of any nationality may also apply for a second year at the Graduate Institute of International and Development Studies in Geneva (IHEID).

The Käte Hamburger Kolleg „Einheit und Vielfalt im Recht“ (EViR, ‘Legal Unity and Pluralism‘) at the Westfälische Wilhelms-Universität Münster is inviting applications for fellowships (6-12 months).

We invite (legal) historians, scholars of applied law, ethnology, sociology, theology, literary studies as well as Jewish and Islamic studies. The fellows’ projects should exhibit clear relevance for both the general aims of the Käte Hamburger Kolleg as well as the respective annual themes. These themes are:

2021/22: Exceptions and Plurality.

2022/23: Modes of Standardisation.

2023/24: Causes of Plurality.

2024/25: Dynamism and Stability.

Your Time at the Kolleg:

During your time as a fellow you are expected to be an active participant in the activities and events hosted by the Kolleg. You will be given the opportunity to present your project in a Fellow-Lecture at the beginning of your fellowship. At the end of your tenure, your research findings should be presented in another paper and published as a journal article or a comparable publication.

In Münster, we offer an inspiring research atmosphere in an interdisciplinary and international setting with many opportunities for collaboration and intellectual exchange with scholars at the Kolleg. You are also encouraged to contribute to the events programme of the Kolleg by proposing a workshop that can be organised in cooperation with our team either during or after your fellowship. However, the central aim of the fellowship is to give you sufficient time to focus on your research topic.

Duration:

We encourage applications for 6-12 month fellowships. The commencement as well as the actual duration of the fellowship will be discussed with the successful applicant. Please state when you plan to stay in Münster in your application. We will repeat the call for applications every six months but we are able to accept applications for fellowships up to 2025.

STIPEND

The stipend is competitive and offers the possibility for a buy-out. The Kolleg covers travel costs to and from Münster. We will provide a fully furnished office and organisational help with visa applications and finding accommodation.

Le droit représente une composante essentielle du monde romain. L’étude des textes juridiques permet non seulement de mettre en lumière une logique argumentative propre au droit et d’identifier les valeurs qui régissent les décisions des juristes et des législateurs, mais aussi de s’approcher au plus près d’un certain nombre de réalités historiques. Il s’agit de sources variées (littéraires, épigraphiques, papyrologiques) qui révèlent l’évolution de la pensée juridique, les principes du droit, ses modalités d’application. Elles laissent également entrevoir des données économiques, des modes de vie, des pratiques sociales. Les textes juridiques constituent donc une documentation riche et utile pour les historiens, qui attend en partie d’être exploitée. Mais une question de méthode se pose : dans quelle mesure peut-on considérer les textes juridiques comme un miroir fiable des réalités économiques, sociales et politiques ? Surtout comment s’orienter parmi la variété des sources, des genres et des éditions des textes juridiques ?

Fondé par Jean-Louis Ferrary, Dario Mantovani et Hélène Ménard en 2017, l’atelier vise à familiariser les participants avec les principaux textes du droit romain et les problèmes de méthode qu’ils suscitent, à partir de leur lecture directe et suivie. La littérature juridique constituera le premier champ d’exploration, à partir du Digeste : nous nous demanderons ainsi ce qu’est un juriste à Rome, comment se fait le droit, quelle est la nature des différents genres littéraires, quelles sont les éditions de référence. Les constitutions impériales, à partir de la Mosaicarum et Romanarum legum Collatio et des Codes, formeront le deuxième terrain de travail.

Les séances se tiendront dans la salle de séminaire de la Place Navone et dans la Bibliothèque Volterra. Constituée à partir du dépôt confié à l’École française de Rome par le grand romaniste Edoardo Volterra, ses extraordinaires fonds ancien et moderne permettront de réfléchir à la transmission des textes antiques et à leur traversée de la culture européenne. L’étude du droit romain, sous la forme des livres dans les rayons de la bibliothèque Volterra, permettra de rendre visible et immédiatement accessible un parcours dans l’histoire de l’historiographie.

La formation sera assurée par Dario Mantovani et Hélène Ménard. Un intervenant, choisi chaque année parmi les chercheurs impliqués dans un projet de recherche international, en donnera une illustration à l'intention des élèves Lors de l'édition 2021, Alberto Dalla Rosa (Université Montaigne, Bordeaux, PI de PATRIMONIVM ERC-StG 716375) sera invité. La séance finale du vendredi 11 juin sera consacrée à la mise en pratique par les participants, organisés par groupes, des méthodes acquises sur l’analyse des sources juridiques.


L’atelier s’adresse aux jeunes chercheurs (Master 2e année, doctorants, post-doctorants), spécialistes d’histoire romaine et médiévale, de philologie ou de droit, plus généralement tout jeune chercheur souhaitant se familiariser avec les sources du droit romain pour son sujet de recherche ou pour développer sa connaissance d’une documentation de première importance.

Il se déroulera sur cinq jours (du lundi au vendredi). Les séances auront lieu de 9h30 à 12h30 puis de 14h30 à 17h30. Les langues utilisées, par les intervenants comme par les participants, seront l’italien et le français.

L’École française de Rome attribue des bourses, qui prennent en charge les frais de séjour ; les frais de transport restent à la charge des participants.

At the end of 2012 Prof. Dr. Erk Volkmar Heyen, who served as Professor of Public Law and European Administrative History at the Ernst-Moritz-Arndt University of Greifswald until his retirement and as editor of the “Jahrbuch für europäische Verwaltungsgeschichte/Yearbook of European Administrative History” (JEV), which ran from 1989 to 2008, endowed a research fellowship in the field of European Administrative History ("The JEV-Fellowship for European Administrative History"). The fellowship falls within the framework of the German University Foundation (Bonn, Germany).

The scholarship is intended to benefit the next generation of researchers, particularly doctoral and post-doctoral students, to enable them to complete their research project in as brief a period as possible, ordinarily up to a maximum of 6 months. The scholarship is based on the usual rates for doctoral fellowships of the German Research Foundation (DFG). Should a fellowship be awarded to a researcher outside Germany, local scholarship rates will be taken into consideration. Marital status will not be taken into account, nor will travel or overhead costs be reimbursed.

The Board of the German University Foundation awards the fellowship on the recommendation of a jury, which is based at the Max Planck Institute for European Legal History (MPIeR) in Frankfurt.

Early stage researchers from Germany and abroad are invited to apply. In accordance with the thematic and methodological spectrum covered by the JEV, the scholarship is open to all historical disciplines, provided the research project addresses an aspect of European administrative history or history of administrative law from the sixteenth to the twentieth century. The relevance of the research topic should not be restricted to a particular national context. Comparative research questions are particularly welcome. It is expected that the research results will be published.

The application, which must also indicate  the intended duration of the fellowship, should include: a tabular CV with details on the applicant’s university education with copies of examination results and diplomas to be enclosed, a list of academic publications, where applicable; a detailed description of the research project including a detailed outline of the intended structure of the resulting book, a detailed report on the current state of the project and writing progress, including the reasons for any delay in its completion; extensive excerpts from the manuscript; information on the project’s previous,  current and planned financing arrangements; a precise timetable to complete the manuscript within the duration of the fellowship. Furthermore, at least one expert opinion on the research project and a personal reference from a university lecturer are to be submitted directly to the jury.

The MPIeR provides fellowship recipients with the opportunity to work in its library. Fellows are given the opportunity to present and discuss their research projects with members of the Institute. Upon expiration of the fellowship, the recipient is to submit a report on the status of the manuscript. The MPIeR provides for the publication of the manuscript in one of its book series, assuming it meets internal and scientific standards. The book is to acknowledge the support provided by the “JEV-Fellowship for European Administrative History” in the masthead or in the preface.

The Max Planck Institute for European Legal History in Frankfurt is a world leader in research on the history of law in Europe and beyond. Its international research community of over 60 scholars, the unrivalled collections of its specialist library and its numerous national and international co-operations make it a central research hub for a global scientific community investigating the past, present and future of legal regimes. We award several Postdoctoral and Research scholarships annually to enable outstanding researchers to spend time at the Max Planck Institute for European Legal History and are now inviting applications for research stays in 2021. Scholarship holders are expected to pursue their own research project, which should relate to the Institute’s current research agenda.

In 2021 scholarships will primarily be awarded to scholars proposing to work on the following topics

Department I – Professor Stefan Vogenauer • Legal transfer in the common law world and more generally • History of European Union law

Department II – Professor Thomas Duve • Goals and methods of writing legal history • Glocalising normativities in the Iberian Worlds (15th – 19th centuries) • Key concepts of the juridical-political language of the School of Salamanca

Scholars who are employed and/or have other forms of financial support can receive compensation for expenses at a fixed rate for the period of their stay. The compensation can, however, only be granted for up to three months and consists of a food allowance of €28 per day and €20 per day for accommodation.

In 2019, the William Nelson Cromwell Foundation will make available a number of $5,000 fellowship awards to support research and writing in American legal history by early-career scholars. Early career generally includes those researching or writing a PhD dissertation (or equivalent project) and recent recipients of a graduate degree working on their first major monograph or research project. The number of awards made is at the discretion of the Foundation. In the past several years, the trustees of the Foundation have made between five and ten awards. Scholars who are not at the early stages of their careers may seek research grants directly from the Foundation. For more information, see the Grants page on the Cromwell Foundation’s website.

The Committee for Research Fellowships and Awards of the American Society for Legal History (ASLH) reviews the applications and makes recommendations to the Foundation. The American Society for Legal History has launched a call for its annual Cromwell Dissertation Prize (for PhDs received in 2018 dealing with American legal history). Here the call:

The William Nelson Cromwell Foundation Dissertation Prize is awarded annually to the best dissertation in any area of American legal history, including constitutional and comparative studies, although topics dealing with the colonial and early national periods will receive some preference.

The author of the winning dissertation receives $5,000. Anyone who received a Ph.D. in 2018 will be eligible for this year’s prize, which is awarded after a review of the recommendation of the Cromwell Prize Advisory Committee of the American Society for Legal History.

PROJET FNRS BELGADVOCATES 1811-1920

L’objectif du projet Belgadvocates est d’élargir la recherche sur les élites judiciaires belges et leur rôle dans la formation du droit, le fonctionnement de la justice et l’animation de la vie politique, en s’intéressant au monde des avocats comme corps socio-professionnel en Belgique.

Le coeur de ce projet est d’étudier sous le double angle de la prosopographie (biographies de groupe) et de l’analyse des réseaux sociaux, des trajectoires individuelles et sociales (dynasties) afin de mettre en évidence comment les élites issues des Révolutions (1780-1830) se sont structurées et ont contribué à structurer et tisser les réseaux du pouvoir dans le nouvel Etat belge jusqu’au choc de la première guerre mondiale, de l’occupation et de la sortie de guerre (1914-1920). Le fil conducteur de la recherche est donc double : d’une part, étudier la professionnalisation de la défense en justice et l’intégration d’une élite en formation dans un Etat neuf ; d’autre part, mesurer les recompositions de ce groupe et de ses membres à travers l’évolution socio-économique et démographique que connaît le 19e siècle ainsi qu’à travers le choc d’une occupation de guerre.

Dans ce cadre : les promoteurs recrutent deux boursie.re.s de doctorat pour 48 mois.

• L’un.e sera plus particulièrement chargé de l’étude de la composition du barreau de Bruxelles de sa création sous Napoléon à la sortie de la première guerre mondiale. Elle/il sera titulaire d’un master 120 en histoire ou dans une autre discipline de sciences sociales avec intérêt pour les méthodes d’analyse des réseaux sociaux et des trajectoires individuelles et sociales.
• L’autre consacrera la recherche à l’étude d’une sélection de barreaux durant la Première guerre mondiale et la sortie de guerre et s’attachera aux multiples fonctions exercées par les avocats durant l’occupation. Il/elle sera titulaire d’un master en histoire ou en en droit, avec des compétences en recherche et traitement d’archives.

La connaissance de l’anglais et du néerlandais sont des atouts, de même que la capacité de travailler en équipe sur l’application de bases de données ‘Prosopographie’.

Les deux candidat.e.s travailleront en équipe dans le cadre du Centre d’histoire du droit et de la justice (UCLouvain) et du Centre d’histoire du droit et d’anthropologie juridique (ULB).

The Stanford Center for Law and History is a residential fellowship that provides an opportunity to conduct research in the dynamic environment of Stanford University. We expect that fellows will dedicate most of their time to pursuing their proposed research projects, and the fellowship is designed to ensure meaningful mentorship from faculty within both the Law School and the History Department. The American Society for Legal History and the Institute for Legal Studies at the University of Wisconsin Law School are pleased to invite applications for the tenth biennial Hurst Summer Institute in Legal History. The purpose of the Hurst Institute is to advance the approach to legal scholarship fostered by J. Willard Hurst in his teaching, mentoring, and scholarship. The Hurst Institute assists scholars from law, history, and other disciplines in pursuing research on the legal history of any part of the world.

The 2019 Hurst Institute will be led by Mitra Sharafi, Professor of Law and Legal Studies (with History affiliation) at University of Wisconsin–Madison. The two‑week program features presentations by guest scholars, discussions of core readings in legal history, and analysis of the work of the participants in the Institute. The ASLH Hurst Selection Committee will select twelve Fellows to participate in this event.

Applicant Qualifications

Scholars in law, history and other disciplines pursuing research on legal history of any part of the world are eligible to apply. Preference will be given to applications from scholars at an early stage of their career (beginning faculty members, doctoral students who have completed or almost completed their dissertations, and J.D. graduates with appropriate backgrounds).

Fellowship Requirements

Fellows are expected to be in residence for the entire two‑week term of the Institute, to participate in all program activities of the Institute, and to give an informal works‑in‑progress presentation in the second week of the Institute.
