Die Anwendung des Verfassungsrechts auf die sich stetig wandelnde Lebenswirklichkeit ist historisch gebunden, nicht aber historisch determiniert. Der Verfassungsnormsetzer delegiert Konkretisierungsspielräume an künftige Generationen, in denen sie die Entwicklung der Verfassung ohne Änderung ihres Textes vollziehen. Maximilian Schneider arbeitet das komplexe Zusammenspiel entstehungs- und geltungszeitlicher Momente in der Verfassungsanwendung heraus. Dafür nutzt er die in der deutschen Rechtswissenschaft bislang weitgehend unbeachtet gebliebenen Erkenntnispotenziale der jüngeren US-amerikanischen Methodendebatte um den Originalism. Er zeigt, wie methodologisch konsistent von entstehungszeitlicher Auslegung gesprochen werden kann, ohne dass diese in eine Versteinerung der Verfassungsanwendung mündet, und warum sie normativ geboten ist.

The MPI in Frankfurt has a call for papers for a hybrid workshop on ‘New Approaches for Extracting Heterogeneous Reference Data’.

Summary

Extracting heterogeneous references from texts, in particular from historical documents and humanities or legal scholarship is an unresolved problem. Yet, there is currently no coordinated effort to develop solutions. We therefore invite scholars and practitioners from the social sciences, the humanities and the informational and computational disciplines to join us in a workshop in which we want to define the problem(s), establish the state of the art and share resources. The overarching aim of the event is to find ways for jointly developing new tools and workflows which are able to unlock previously untapped reference/citation data in the humanities, law and the social sciences. A particular focus lies on newly emerging technologies that are based on (pre-trained) language models.

ROUNDTABLE: The Historical Turn in International Economic Law - Ghent/Brussels, 12.10.2021 – 12h30-14h (on Zoom)

The historical turn in international has been followed by various subdisciplinary turns to, for example, the history of human rights law, international humanitarian law and international criminal law. Nevertheless, the origins and history of international economic law has received less attention from both international economic lawyers and international legal historians. This roundtable will reflect on the current state of the art, its gaps and potential avenues for future research, in particular with respect to interdisciplinarity, periodization, method, the role of non-state actors and eurocentrism.
