Abstract:
The idea of the Volksgeist (national spirit) was an integral part of the theory of legal sources in the early 19th century, primarily associated with Friedrich Carl von Savigny. However, the idea of a creative Volksgeist is not only to be found in Savigny's works. Throughout his life, the avowed Savigny disciple Jacob Grimm was preoccupied with the question of the "origin", be it of language, of culture, but also of law. The idea of a genuine national spirit was an integral part of his scientific conception early on and had a decisive influence on his entire work. At the same time, Grimm's concept of Volksgeist was a very individual one, differing significantly from the concepts of his models and contemporaries and influencing legal German studies well into the 20th century.
