Saskia Lettmaier, Professor of Law and Global Legal History at the University of Hamburg, will present her paper, "Marriage and Madness: The Origins of the Marriage of Lunatics Act of 1742"

Abstract:

In 2021, the Parliament of the Irish Republic—as the last legislature in Great Britain and Ireland—abolished an Act to Prevent the Marriage of Lunatics. This Act had its origins in a British statute of 1742, which was subsequently extended to Ireland and was in force in all parts of the British isles from 1811 until 1959, when it was abolished for England and Wales. The Act has been almost completely ignored by (legal) history. Quite undeservedly so, for it may claim to be the first English general act since the Elizabethan settlement to interfere with the traditional canon law of marriage, predating the much more famous Hardwicke Marriage Act by more than a decade. It rendered absolutely void the marriages of persons who had been found lunatic by commission under the Great Seal or whose persons and estates had been placed under trustees by Act of Parliament. Such persons could no longer contract a valid marriage after 24 June 1742, not even during a lucid interval, unless they had first been declared of sound mind by the Lord Chancellor or other competent authority. Yet there is little evidence to suggest that unsuitable marriages by lunatics constituted a widespread social problem in mid-eighteenth-century England. Given the English reluctance to pass general acts in this period, why was the esoteric topic of lunatics’ marriage singled out for general legislative treatment, rather than being dealt with—like the thorny issue of divorce—through private acts on a case-by-case basis? This paper seeks to answer that puzzle. In doing so, it explores the intersection of marriage law, property protection, elite family strategy, and parliamentary power, taking us into the worlds of high society and high politics in eighteenth-century Britain.

Abstract:

Centre majeur de l’enseignement du droit au Moyen Âge, la ville de Bologne se caractérise par la production de manuscrits juridiques. La BnF en possède une collection de premier plan, ce qui a été bien souligné par des travaux récents. Un exemplaire du Digeste Infortiatum glosé par Accurse, auteur de la Magna glossa, constitue un fleuron de ce corpus. Cette intervention soulignera la transposition du langage juridique en langage figuratif dans les manuscrits de droit romain enluminés du XIIIe au XVe siècle dans la cité universitaire.

Archiviste paléographe (prom. 1987), il a été adjoint au directeur des Archives départementales de la Côte-d’Or, puis chargé de recherche au CNRS auprès du Centre Georges-Chevrier de l’Université de Bourgogne. Il est titulaire d’un doctorat en droit et d’une habilitation à diriger des recherches en droit. Il a été élu en 2007 professeur à l'École nationale des chartes. Sa thèse d’École nationale des chartes a porté sur les écrits politiques de l’archevêque de Toulouse Bernard de Rosier (1400-1475), sa thèse de doctorat sur l’œuvre politique du canoniste toulousain Guillaume Benoît (1455-1516) – publiée sous le titre Les idées politiques à Toulouse à la veille de la Réforme en 2003 – et son habilitation sur l’historiographie, les idées politiques et l’enseignement du droit en France aux xive-xvie siècle. Il est rattaché à l’École doctorale conjointe de l’École nationale des chartes - PSL et de l’Université Paris Sorbonne. Il a été directeur du Centre Jean-Mabillon. À partir des Archives personnelles de Gabriel Le Bras (données à l’EHESS et déposées aux Archives Nationales) et des Archives du CNRS, une petite équipe associant l’ENS, l’ENC (Katia Weidenfeld et Patrick Arabeyre) et l’EHESS, se propose d’analyser les documents de ces fonds et d’organiser en 2018 une journée d’études, avec le concours de la Société d'histoire religieuse de la France. Lancement en 2018 du Séminaire "Humanisme juridique" avec l'IHD de Paris II.

Archiviste paléographe (prom. 2010) et docteur en histoire de l’art, Sabine Maffre est l’auteure d’une thèse portant sur l’iconographie de Caïn et Abel en France au Moyen Âge soutenue à l’Université de Poitiers en 2023 sous la direction de Cécile Voyer. Conservatrice des bibliothèques, elle a été responsable pendant cinq ans de la bibliothèque Carnegie, bibliothèque patrimoniale à Reims. Depuis 2018, elle est chargée de collections pour la période xiiie siècle-xive siècle au service médiéval du département des Manuscrits de la Bibliothèque nationale de France. Sa thèse d’École (2010) porte sur L’iconographie de Caïn et Abel en France du xie siècle au début du xvie siècle.

SEMINAR: The Global History of the Establishment of the Permanent Court of International Justice, 1919 to 1922 (Copenhagen: CEMES/INNER_LEAGUE ERC Project, 1-2 DEC 2025)

Abstract:

This seminar will discuss the draft book chapters of a new monograph on the establishment of the Permanent Court of International Justice (PCIJ). The book will tell the story of how the PCIJ was imagined, developed and established from the negotiations of the Covenant in Spring 1919 as part of the Peace Treaty negotiations over the famous negotiations of the court Statute by the Advisory Committee of Jurists in Spring of 1920 to the ultimate decision on the nature of the Court and the selection of judges by the League of Nations Council and Assembly in 1920-1921. The opening meeting of the PCIJ took place on 15 February 1922 and would fundamentally change the system of international law and its historical trajectory.

On the occasion of Prof. Lauren Benton’s (Yale University) visit and conference to the Louvain Lab for Law, History and Society (LHS) at UCLouvain on 15 October 2025, a doctoral research seminar will be held, open to all PhD candidates in law, history, and legal history in Belgium. This workshop will take the form of an encounter between Prof. Benton and early-career researchers, giving participants the opportunity to discuss their doctoral research on one of the following themes: History of law and justice, across all periods History of empires Global and comparative history Colonial history and the history of colonial law History of violence History of international law 

Each participant is invited to give a 10-minute presentation in English on their doctoral research, followed by a discussion with Prof. Benton. To take part in this workshop, please send your paper proposal (350-word abstract + CV) to quentin dot verreycken at uclouvain dot be no later than 30 September 2025. Lauren Benton is Barton M. Biggs Professor of History and Professor of Law at Yale University. Her research focuses primarily on the global history of empires and the history of international law. Résumé

À partir d’une sélection de publications, Anne Rousselet-Pimont et Xavier Prévost dialogueront sur la place des juristes dans l’historiographie de l’humanisme juridique. Ils se demanderont quelles peuvent être les contributions spécifiques des spécialistes du droit à la compréhension de ce mouvement intellectuel fondé sur une approche encyclopédique du savoir. Pour cela, ils reviendront notamment sur la dimension politique de l’humanisme juridique, en particulier le rôle joué par ses membres dans la construction de l’État moderne.

 

Professeur à l’université Paris 1 Panthéon-Sorbonne, Anne Rousselet-Pimont enseigne l’histoire du droit et dirige le M2 Histoire de la pensée juridique moderne. Elle est membre de l’Institut de recherche juridique de la Sorbonne (IRJS). Ses travaux portent sur l’histoire des sources du droit, l’histoire de la justice et l’histoire de la comparaison des droits et interrogent plus particulièrement la méthode et le discours des anciens juristes. Spécialisée dans l’histoire de la première modernité, elle appartient au Réseau Humanisme juridique, à la Société d’histoire du droit (SHD) et à l’Association des historiens des facultés de droit (AHFD).

Xavier Prévost est agrégé des facultés de droit, agrégé d'économie et gestion, archiviste paléographe (diplômé de l'École des chartes) et ancien élève de l'ENS Cachan. Membre junior de l'Institut universitaire de France (promotion 2020), il est professeur d'histoire du droit à l'université de Bordeaux et porteur du projet ISTHisFrench (ERC-2024-COG 101170233). Il coordonne avec Luigi-Alberto Sanchi le Réseau Humanisme juridique. Ses recherches concernent le droit et les savoirs juridiques à la Renaissance et interrogent, en particulier, l'émergence de la modernité juridique.
