Brill is publishing a new essay collection on the history of rights.

ABOUT THE BOOK

The essays in this volume explore the ways rights were available to those in the margins of society. By tracing pivotal judicial concepts such as ‘right of necessity’ and ‘subjective rights’ back to their medieval versions, and by situating them in unexpected contexts such as the Franciscans’ theory of poverty and colonization or today’s immigration and border control, this volume invites its readers to consider whether individual rights were in fact, or at least in theory, available to the marginalized. By focusing not only on the economically impoverished but also those who were disenfranchised because of disability, gender, race, religion or infidelity, this book also sheds light on the relationship between the early history of individual rights and social justice at the margins.

ABOUT THE EDITORS

Virpi Mäkinen is Senior Lecturer in Theological and Social Ethics at the University of Helsinki, Finland. She has published monographs and many articles on medieval and early modern intellectual history, including Property Rights in the Late Medieval Discussion on Franciscan Poverty (Peeters, 2001), and co-edited Transformations in Late Medieval and Early-Modern Rights Discourse (Springer, 2006). 

Jonathan Robinson, Ph.D. (2010) in Medieval Studies at the University of Toronto, Canada. He currently acts as a lawyer and is the author of William of Ockham’s Theory of Property Rights in Context (Brill, 2012).

Pamela Slotte is Associate Professor of Minority Studies at the Åbo Akademi University, Finland. She is the co-author of The Juridification of Religion (Brill, 2017) and co-editor of Revisiting the Origins of Human Rights (Cambridge University Press, 2015). 
Heikki Haara is Senior Lecturer of Political History at the University of Helsinki. He is the author of Pufendorf’s Theory of Sociability: Passions, Habits and Social Order (Springer, 2018).

Prior to the nineteenth century, the West occupied an anomalous space in the Chinese imagination, populated by untamable barbarians and unearthly immortals. First-hand accounts and correspondence from Qing envoys and diplomats to Europe unraveled that perception. In this path-breaking study, Jenny Huangfu Day interweaves the history of Qing legation-building with the personal stories of China's first official travelers, envoys and diplomats to Europe. She explores how diplomat-travelers navigated the conceptual and physical space of a land virtually unmapped in the Chinese intellectual tradition and created a new information order. This study reveals the fluidity, heterogeneity, and ambivalence of their experience, and the layers of tension between thinking, writing, and publishing about the West. By integrating diplomatic and intellectual history with literary analysis and communication studies, Day offers a fundamentally new interpretation of the Qing's engagement with the West.

Abstract:
Le droit a son propre langage, et même plusieurs. La circulation des droits d'un pays à un autre, d'une époque à l'autre, suppose la possibilité de pouvoir saisir ce droit voyageur. Pour traverser les frontières et les âges, il doit être traduit. Mais que traduit-on lorsqu'on traduit le droit ? La différence fondamentale formulée par Ferdinand de Saussure - entre sens (contenu intrinsèque du terme) et valeur (contenu du terme tel qu'il résulte des relations qu'il entretient avec d'autres termes relevant d'un même système linguistique) d'un mot - prend une dimension toute particulière dans le domaine juridique : ce qui y distingue le sens de la valeur n'est pas seulement l'intégration du mot dans un système linguistique donné, mais aussi et surtout dans un système juridique spécifique. La question de la traduction juridique s'entend donc en réalité à plusieurs niveaux. Il n'y est pas seulement question de traduire les mots du droit ; s'y mêlent aussi la question de la possibilité de traduire la distance qu'entretient la langue juridique avec la langue commune au sein de chaque système linguistique, et celle de la capacité à transcrire les réalités juridiques inhérentes à un système juridique dans des langues par lesquelles se pensent et se formulent des règles auxquels ces réalités sont étrangères. Historiens du droit et comparatistes sont sans cesse confrontés à cette passionnante mais redoutable difficulté. L'ambition du colloque était de questionner les pratiques multiples de la traduction juridique, à la fois dans leur épaisseur historique et dans leur amplitude transfrontalière. Asseoir l'autorité, établir le dialogue et diffuser le savoir ont été les trois temps autour desquels se sont articulés les interventions académiques et retours d'expérience multiples.

As a legal scholar who first argued in the early 1990s for a right to gay marriage, William N. Eskridge Jr. has been on the front lines of the debate over same-sex marriage for decades. In this book, Eskridge and his coauthor, Christopher R. Riano, offer a panoramic and definitive history of America’s marriage equality debate. The authors explore the deeply religious, rabidly political, frequently administrative, and pervasively constitutional features of the debate and consider all angles of its dramatic history. In The Excommunication of Elizabeth I, Aislinn Muller examines the excommunication and deposition of Queen Elizabeth I of England by the Roman Catholic Church, and its political afterlife during her reign. Muller shows that Elizabeth’s excommunication was a crucial turning point for both Catholics and Protestants, one that irrevocably changed attitudes towards the queen, widened political participation and resistance, and posed a destabilising threat to her regime. The Excommunication of Elizabeth I demonstrates how this event exacerbated religious tensions in England’s foreign and domestic politics, and how Elizabeth’s conflict with the papacy shaped the development of anti-Catholicism in post-Reformation England.

Aislinn Muller obtained her Ph.D. in History at the University of Cambridge (2017). Her work on religious politics in post-Reformation England has appeared in publications such as British Catholic History and Studies in Church History. This is her first book.

This book explores the history of the international order in the eighteenth and nineteenth century through a new study of Emer de Vattel’s Droit des gens (1758). Drawing on unpublished sources from European archives and libraries, the book offers an in-depth account of the reception of Vattel’s chief work. Vattel’s focus on the myth of good government became a strong argument for republicanism, the survival of small states, drafting constitutions and reform projects and fighting everyday battles for freedom in different geographical, linguistic and social contexts. The book complicates the picture of Vattel’s enduring success and usefulness, showing too how the work was published and translated to criticize and denounce the dangerousness of these ideas. In doing so, it opens up new avenues of research beyond histories of international law, political and economic thought.

Antonio Trampus is Professor of Modern History at Ca’ Foscari University Venice, Italy. His research focuses on cultural history and constitutionalism. Our ideas about the long histories of young couples' relationships and women's efforts to manage their reproductive health are often premised on the notion of a powerful sexual double standard.

In Sex in an Old Regime City, Julie Hardwick offers a major reframing of the history of young people's intimacy. Based on legal records from the city of Lyon, Hardwick uncovers the relationships of young workers before marriage and after pregnancy occurred, even if marriage did not follow, and finds that communities treated these occurrences without stigmatizing or moralizing. She finds a hidden world of strategies young couples enacted when they faced an untimely pregnancy. If they could not or would not marry, they sometimes tried to terminate pregnancies, to make the newborn go away by a variety of measures, or to charge the infant to local welfare institutions. Far from being isolated, couples drew on the resources of local communities and networks. Clerics, midwives, wet nurses, landladies, lawyers, parents, and male partners in and outside the city offered pragmatic, sympathetic ways to help young, unmarried pregnant women deal with their situations and hold young men responsible for the reproductive consequences of their sexual activity. This was not merely emotional work; those involved were financially compensated. These support systems ensured that the women could resume their jobs and usually marry later, without long-term costs. In doing so, communities managed and minimized the disruptions and consequences even of cases of abandonment and unprosecuted infanticide.

This richly textured study re-thinks the ways in which fundamental issues of intimacy and gendered power were entwined with families, communities, and religious and secular institutions at all levels from households to neighborhoods to the state.

Abstract:
Das 16. und 17. Jahrhundert ist für die Völkerrechtsgeschichte von besonderer Bedeutung. Aufgrund der spanischen Expansion in der Neuen Welt und der konfessionellen Konflikte in Europa wurden völkerrechtliche Fragen kontrovers diskutiert. Während der römisch-katholische Anteil des Völkerrechtsdiskurses bereits Gegenstand zahlreicher Untersuchungen wurde, ist der protestantische Beitrag zur Genese und Ausdifferenzierung des frühneuzeitlichen Völkerrechts weitgehend unbekannt. Michael Becker befasst sich daher mit den Werken protestantischer Theologen, Juristen und anderer Gelehrter, die sich zu Fragen des Völkerrechts geäußert haben. Anhand von spezifischen Problemstellungen aus dem Bereich des Kriegs- und Bündnisrechts (religiöse Offensiv- und Verteidigungskriege, Bündnisse zwischen unterschiedlichen Konfessionen) zeigt er, dass protestantische Gelehrte den Völkerrechtsdiskurs mitgeprägt haben. Les inscriptions pour le 11e Congrès de l’Association des Cercles francophones d’histoire et d’archéologie de Belgique sont ouvertes. Il était prévu à Tournai du jeudi 20 au dimanche 23 août 2020, mais a été reporté au 19-21 août 2021.

Ce congrès sera aussi le 58e Congrès de la Fédération des Cercles d’archéologie et d’histoire de Belgique, Il prend place en Wallonie picarde sera organisé par trois sociétés hainuyères associées pour la circonstance : le Cercle royal d’histoire et d’archéologie d’Ath et de la région, la Société d’histoire de Mouscron et de la région et la Société royale d’histoire et d’archéologie de Tournai. Il bénéficiera en outre de la collaboration de Hannonia. Centre d’information et de contact des cercles d’histoire, d’archéologie et de folklore du Hainaut.

Les communications auront une durée maximum de 20 minutes. Le choix de la langue est libre (français, néerlandais, allemand). Le français demeure la langue officielle du Congrès.

In current academic and political debates, the tensions between European conceptions of the welfare state and transnational migration are a heatedly discussed issue. How can promises of social security be kept in times of globalization? Is welfare only feasible in ‘closed’ nation states with tight border controls, or is migration, to the contrary, necessary for sustaining welfare systems? To what extent are social rights a privilege of national citizens, to what extent, and under what conditions, are they also due to foreign immigrants? Such questions have become an explosive and intensely scrutinized subject. Much less, however, is known about their historical dimensions. There exists by now a rich historiography on the origins of modern welfare policies; migration history is flourishing too; and in recent years, the history of citizenship has attracted increasing attention. Yet, these have largely remained three separate fields of research. Few works have studied in detail so far how European welfare states dealt with the challenges of migration in their formative phase, and what experiences, in turn, migrants have made with the social services of their host societies. The project “The Borders of the Welfare State: Migration, Social Rights and Expulsion (1850-1933)” is attempting to fill this gap. Taking as its starting point the frequently postulated, but probably too simplistic hypothesis that the status of aliens deteriorated inversely to the expansion of citizens’ rights with the emergence of modern national welfare states, it explores the interrelations of labour migration and social policies in the decades around 1900. The project compares national discourses and legal frameworks of various European countries, analyses concrete administrative practices at the local level, and looks at the beginnings of international agreements on the reciprocal treatment of citizens who moved across borders. The aim is to write a transnational European history of the negotiations over the social entitlements of migrants in the early days of modern welfare-state building. Despite its transnational approach, the scope of the project is necessarily limited, in geographical and temporal terms as well as in terms of the aspects of ‘welfare’ and ‘migration’ it is able to take into account. Therefore, the planned workshop wants to open up its horizon by bringing together researchers who are working on related topics. Invited are historians, but also scholars from neighbouring disciplines (sociology, political sciences, anthropology, etc.) with a research interest in the interrelationships of migration and social policies from the eighteenth century to the present. Although the focus of the workshop will be on the evolution of European migration and welfare regimes, papers that offer extraEuropean perspectives are very welcome too. And although the focus will be on the impact of migration on ‘modern’ social policies and vice versa, also early modern historians are addressed who can help us to understand continuities and changes during the transition to modernity. Possible approaches of papers that explore the interrelationships of migration and social policies include: - Theoretical reflections on long-term developments - Semantics of welfare, belonging and social rights - Comparisons between national migration and welfare regimes - Case studies on local constellations and experiences - Case studies on specific migrant groups or specific sectors of welfare provision - Case studies on periods of disruption, e.g. in the wake of wars or economic crises - Transnational studies on the cross-border coordination of migration and social policies The workshop is funded by the DFG (German Research Foundation) and will take place in Berlin from 4 to 5 March 2021 at the premises of re:work. The organizers will provide accommodation as well as (limited) reimbursement of travel expenses. Should travel restrictions or other impediments to on-site events due to the Covid-19 pandemic still be in force, we will consider switching to an, in parts, digital format. Presentations should not exceed 20 minutes. We plan to publish a selection of revised papers. We would like to draw your attention to the two day conference "Social Status or Legal Difference? The Rank of Slaves in Antique Roman Society" organized by Prof. Dr. Martin J. Schermaier and the Bonn Center for Dependency and Slavery Studies

The conference is scheduled to take place online via Zoom on August 28-29, 2020.

It is well known that Roman slaves did not form a homogeneous group but belonged to different social ranks. That mostly depended on the kind of work they exercised. Did private or public law reflect such differences? Did it help to institutionalize them? Did legal provisions or decisions even foster them? These are the main questions dealt with in the papers to be presented.

All lecturers are renowned experts in the field of Roman slave law.

This conference aims to explore historical, political and cultural connections between Latin America, Asia and Africa during the decolonization process and the Cold War from an interdisciplinary perspective. Traditionally, the history of the ‘international’ has been presented from the perspective of major Western European and North American powers, based on their specific experience of the events and according to their imperial expansion, geostrategic and economic interests, the challenges they faced and the strategies they developed to counter them, and more generally the political and cultural or ideological climate and circumstances prevalent in the Europe and North America. Little attention has been paid to works developed taking into account or written from the perspective of the territories that were the object of the Western European and North American powers’ projection and interests. Networks, connections and alliances that were put into place by state and non-state actors coming from the so-called Global South that did not serve or follow those projections and interests were overlooked by historians. Although in the last two decades some works have appeared in the fields of Political Science and Economy, these are limited in number and moreover do not offer an adequate historical perspective. In addition, fields such as Diplomacy, Visual Studies or the Arts remain largely understudied if not unexplored. This is due to several reasons, among them the difficulty to access primary sources, instability or insecurity in different Global South countries, long distances among them and language diversity. The aim of the conference is to fill this gap by fostering the mapping of South-South connections between Latin America, Asia and Africa.

The Direito e Práxis Journal, associated to the Post-Graduate Program in Law at the State University of Rio de Janeiro (UERJ), invites interested scholars to submit proposals for articles to be published as part of the June 2021 dossier “Critical Legal Studies: debating the anti-liberal tradition of critical legal studies”, organized by the invited editors of the Journal, Professors André Luiz Souza Coelho, Júlia Ávila Franzoni and Philippe Oliveira de Almeida, all of them from the Federal University of Rio de Janeiro (UFRJ) Law School.

The dossier’s purpose is to encourage the publication of research on the genesis and development of Critical Legal Studies, the theoretical currents emerging from it and the possibilities for updating and applying its categories and methods to problems of today. Emerging in the early 1970s, in US law schools such as Harvard and Yale, Critical Legal Studies became one of the most cohesive and combative strands of “postmodern” critical legal thinking. Despite suffering a decline in the 1990s — due to the neoliberal backlash after the fall of the Berlin wall, that disseminated the “unique thought” and the “end of history” in law schools — Critical Legal Studies provided research strategies to the countermajoritarian currents of legal thought that remain important even today. In addition to the “retrospective rationalization” tactics of the current law, widely used by positivist dogmatics, Critical Legal Studies experimented with new ways to study the legal-political reality — such as counter-narratives, which put individuals, with their particularities and contingencies, front and center in the critical studies of Law. Led by figures such as Roberto Mangabeira Unger, Duncan Kennedy and Mark Tushnet, Critical Legal Studies proposed new strategies for thinking, teaching and practicing law, escaping, at the same time, normativist formalism and Marxian orthodoxy. Now, the spirit of Critical Legal Studies survived in currents that flourished by making use of theoretical tools developed by the crits to face realities that they did not contemplate, as is the case with Critical Race Theory (Derrick Bell , Patricia Williams, Mari Matsuda, Richard Delgado, etc.); DisCrit — Dis / ability Critical Race Theory (David J. Connor, Beth A. Ferri, Subini A. Annamma, etc.); and Critical Legal Geography (by David Delaney, Richard T. Ford, Nicholas Blomley, Mariana Valverde, Andreas P. Mihilopoulos, etc).

The dossier will accept papers and translations related to Critical Legal Studies in general (and its developments, the Critical Race Theory, DisCrit, QueerCrit, Critical Legal Geography etc.), as well as specific thinkers associated to the group (Karl Klare, Mark Kelman, Drucilla Cornell …) and their impact on critical legal thinking in Latin America. Monographic studies on specific aspects related to influences, controversies, research methodologies and combat strategies employed by crits will also be welcome. And, finally, the call also aims at giving greater visibility to research that, using these methodological tools and many others correlated (colonial [anti? counter? post?] thinking, political ecology, social reproduction theory, for example, which, from the 1970s to the present day, were experimented with by Critical Legal Studies and its ramifications), seeks to reflect on the scenario in which we live now — marked by the covid-19 pandemic as a total social event, which intersects, and often accelerates, other harmful processes, such as the climatic emergency, the rise of right-wing populism, necropolitics and the precarization of labor.

Papers in Portuguese, English or Spanish will be accepted.

Abstracts should be sent to ejc.fndufrj@gmail.com in the format described below until August 30th. Proposals accepted for development will receive consideration from the editors, and the full papers must be delivered until December 15th, 2020.

Proposals must contain:
• Authors’ name, e-mails, qualifications and institutional links.
• A summary of a maximum of 1,000 words clearly indicating the object of the work, its hypotheses, the method that will be used in the development of the research, the expected conclusions and the contribution of the research to the field.

The conference focus will lie mainly on the transformations underwent by elites during the second half of the 19th century and the first half of the twentieth century, and the deriving social mobility. While political and administrative upper layers form the main cohort of interest, papers on other social and professional elite categories (economic elite, church representatives, intellectuals, etc.) are equally welcome. ABOUT THE BOOK

The Development of Commercial Law in Sweden and Finland provides a broad perspective on recent research into the history of North European commercial law in a comparative and international framework. The book brings together themes that have previously been considered largely from a national perspective. Despite Sweden's and Finland's peripheral locations in Europe, global legal phenomena took place there as well. These countries were at the crossroads of cultures and commercial interests, allowing us to re-examine them as lively laboratories for commercial laws and practices rather than dismissing them as a negligible periphery. The importance of trade and international transactions cannot be disclaimed, but the book also emphasizes the resilient nature of commercial law.
